AN ACT concerning education; establishing Erin's law; requiring school
districts to provide teacher training and age-appropriate student
instruction on the identification and reporting of signs of child sexual
abuse.
Be it enacted by the Legislature of the State of Kansas:
Section 1. (a) Beginning in school year 2026-2027, each board of
education of a school district shall provide an annual training program on
child sexual abuse and sexual assault awareness and prevention to all
teachers of the school district. The training program required by this
subsection shall include:
(1) Actions that a teacher may or shall take to prevent and report
child sexual abuse and sexual assault;
(2) how to identify signs of child sexual abuse and sexual assault; and
(3) information on sexual abuse and sexual assault resources and
supports.
(b) Beginning in school year 2026-2027, each board of education of a
school district shall provide a program of instruction on child sexual abuse
and sexual assault awareness and prevention to all students enrolled in and
attending kindergarten or any of the grades one through 12 of the school
district. The program of instruction required by this subsection shall
include:
(1) Age-appropriate instruction in sexual abuse and sexual assault
awareness and prevention;
(2) actions that a child may take to prevent and report sexual abuse or
sexual assault;
(3) a procedure that allows the parent or guardian of a student to opt
the student out of such instruction; and
(4) information on sexual abuse and sexual assault resources and
supports.
(c) The training and instruction required by this section may be
developed or provided by a child advocacy center, the no-cost Erin's law
foundation curriculum or other resources deemed appropriate by the board
of education of the school district.
Sec. 2. This act shall take effect and be in force from and after its
publication in the statute book.
