AN ACT concerning public safety; creating the Kansas law enforcement
trust fund; establishing the purposes and requirements for such fund;
authorizing such fund to retain interest earnings; making a transfer
from the state general fund to the Kansas law enforcement trust fund
during the fiscal year ending June 30, 2027.
Be it enacted by the Legislature of the State of Kansas:
Section 1. (a) There is hereby created in the state treasury the Kansas
law enforcement trust fund. The Kansas criminal justice coordinating
council established in K.S.A. 74-9501, and amendments thereto, shall
administer such fund. All moneys credited to such fund shall be used to
provide:
(1) Direct aid in the form of grants to state, local and tribal law
enforcement agencies to replace technology, purchase equipment or
enhance public safety; or
(2) matching funds when any such law enforcement agency is
applying for federal or private grants.
(b) A law enforcement agency shall be eligible to receive moneys
from such fund upon certifying such agency's adherence to common
technology standards that ensure interoperability statewide to the greatest
extent possible. All expenditures from such fund shall be made in
accordance with appropriation acts upon warrants of the director of
accounts and reports issued pursuant to vouchers approved by the
chairperson of the Kansas criminal justice coordinating council or the
chairperson's designee.
(c) The Kansas criminal justice coordinating council shall adopt
requirements for the awarding of moneys from the Kansas law
enforcement trust fund.
(d) On or before the 10 th of each month, the director of accounts and
reports shall transfer from the state general fund to the Kansas law
enforcement trust fund interest earnings based on the:
(1) Average daily balance of moneys in the Kansas law enforcement
trust fund for the preceding month; and
(2) net earnings rate of the pooled money investment portfolio for the
preceding month.
(e) On July 1, 2026, or as soon thereafter as moneys are available, the

director of accounts and reports shall transfer $125,000,000 from the state
general fund to the Kansas law enforcement trust fund.
(f) Any moneys approved by the Kansas criminal justice coordinating
council for distribution to a state, local or tribal law enforcement agency
shall be paid from the aggregate interest earnings accrued in the Kansas
law enforcement trust fund as of the date of such approval. The amount of
the initial transfer prescribed by subsection (e) shall remain intact and
inviolate in such fund and be used solely for the purpose of generating
interest earnings that may be awarded by the Kansas criminal justice
coordinating council in the form of grants and matching funds in
accordance with this section.
Sec. 2. This act shall take effect and be in force from and after its
publication in the statute book.
