AN ACT relating to children's health and welfare fiscal impact statements. 1
Be it enacted by the General Assembly of the Commonwealth of Kentucky: 2
SECTION 1. A NEW SECTION OF KRS CHAPTER 6 IS CREATED TO 3
READ AS FOLLOWS: 4
(1) No bill or resolution that relates to the health or welfare of children shall be voted 5
on by a standing committee of either chamber of the General Assem bly unless a 6
children's health and welfare fiscal impact statement has been prepared and 7
attached to the bill or resolution pursuant to this section. 8
(2) (a) The director of the Legislative Research Commission shall have a children's 9
health and welfare fis cal impact statement prepared by the Legislative 10
Research Commission or by other departments or agencies of state 11
government for any bill or resolution introduced before the General 12
Assembly that relates to any aspect of children's health or welfare and th at 13
would cause the state or a local government to incur a cost. 14
(b) Departments or agencies of state government requested by the director to 15
prepare a children's health and welfare fiscal impact statement under this 16
subsection shall comply with the request within seven (7) working days of 17
receipt. 18
(c) The children's health and welfare fiscal impact statement shall be filed with 19
the clerk of the chamber of the General Assembly in which the bill or 20
resolution was introduced and attached to each copy of the bill or 21
resolution. 22
(3) The Legislative Research Commission may submit to any other department or 23
agency of state government, or to any local government, any request for 24
information concerning fiscal management and fiscal conditions that relate to 25
child health or welfare. Each recipient shall be required to comply with requests 26
under this subsection within seven (7) working days. 27

(4) A children's health and welfare fiscal impact statement shall state whether the 1
bill or resolution is determined to be a state mandate on local government. This 2
determination shall be made by the director of the Legislative Research 3
Commission, except as provided by subsection (5) of this section. If the bill or 4
resolution is a state mandate on local government, the statement shall contain an 5
estimate of the effect the law wil l have on expenditures or revenues of local 6
government for the first full fiscal year the law is to be in effect. 7
(5) The director of the Legislative Research Commission, at his or her discretion, 8
may seek a certification from the Attorney General on the q uestion of whether a 9
bill or resolution constitutes a state mandate on local government. The Attorney 10
General shall, within seven (7) working days from receipt of the request, certify to 11
the director that the bill or resolution is or is not a state mandate. 12
(6) If any bill or resolution is amended after the preparation of the children's health 13
and welfare fiscal impact statement, it shall be resubmitted to the person 14
responsible for preparation of the statement, who shall reevaluate the bill or 15
resolution a s amended and change the statement in accordance with the 16
amendment. 17
(7) Copies of the children's health and welfare fiscal impact statement shall be 18
furnished by the Legislative Research Commission to any school official upon 19
written request. 20
(8) The director of the Legislative Research Commission shall establish policies and 21
procedures to ensure the accurate and timely production of children's health and 22
welfare fiscal impact statements, including but not limited to: 23
(a) Establishing a system for collecti ng, compiling, and analyzing fiscal and 24
other information from the state health and welfare system; 25
(b) Delegating responsibilities for aspects of the children's health and welfare 26
fiscal impact statement process to the various staff members of the 27

(c) Establishing the format and design of the statements. 2
