AN ACT relating to keeping chickens on residential property. 1
Be it enacted by the General Assembly of the Commonwealth of Kentucky: 2
SECTION 1. A NEW SECTION OF KRS CHAPTER 65 IS CREATED TO 3
READ AS FOLLOWS: 4
(1) As used in this section, "backyard chicken": 5
(a) Means a domesticated hen kept on residential property for personal egg 6
production or educational purposes; and 7
(b) Does not mean a domesticated hen used for commercial farming or a 8
domesticated rooster. 9
(2) A city, urban -county government, charter county government, consolidated local 10
government, or unified local government: 11
(a) Shall not enact or enforce any ordinance, zoning regulation, or policy that 12
directly or indirectly prohibits a person from keeping six (6) or fewer 13
backyard chickens on any residential property; and 14
(b) May enact and enforce reasonable ordinances, regulations, or policies to 15
ensure the health, safety, and welfare of residents, including but not limited 16
to: 17
1. Requiring setbacks for co ops holding backyard chickens from 18
property lines and neighboring residences; 19
2. Requiring sanitation and maintenance standards relating to backyard 20
chickens to control odors and pests; and 21
3. Prohibiting the commercial sale of eggs or backyard chickens on 22
residential properties. 23
(3) Any ordinance, regulation, or policy that conflicts with this section shall be void 24
and unenforceable. 25
