AN ACT relating to sex crimes. 1
Be it enacted by the General Assembly of the Commonwealth of Kentucky: 2
SECTION 1. A NEW SECTION OF KRS CHAPTER 532 IS CREATED TO 3
READ AS FOLLOWS: 4
(1) (a) Any person who has been convicted of, pled guilty to, or entered an Alford 5
plea to a sex crime, as defined in KRS 17.500, in which the victim was 6
under the age of twelve (12) at th e time of the commission of the offense 7
shall undergo medroxyprogesterone acetate treatment or its chemical 8
equivalent, in addition to any other penalties. 9
(b) The court shall designate in its judgment if the victim was under the age of 10
twelve (12) at the time of the commission of the offense. 11
(2) A person shall begin medroxyprogesterone acetate treatment no later than one (1) 12
month prior to his or her release from custody. Treatment shall: 13
(a) Be administered by the Department of Corrections or any entity with whom 14
the department contracts to provide treatment; and 15
(b) Continue until the person is released from probation, parole, or 16
postincarceration supervision. 17
(3) (a) A person shall pay for a ll of the costs associated with medroxyprogesterone 18
acetate treatment unless the person is determined to be a needy or indigent 19
person under KRS Chapter 31. 20
(b) If a person is determined to be a needy or indigent person under KRS 21
Chapter 31: 22
1. The Commonw ealth shall pay for all of the costs associated with 23
medroxyprogesterone acetate treatment; and 24
2. A periodic review of the person's status as a needy or indigent person 25
may be conducted by the court upon motion by the Commonwealth's 26
attorney. 27

(4) Prior to the administration of medroxyprogesterone acetate, the person shall: 1
(a) Be evaluated by a licensed physician to determine if the person is an 2
appropriate candidate for treatment; 3
(b) Be informed about the effect of the treatment and any side effects that may 4
result; and 5
(c) Authorize the release of all medical records related to the evaluation under 6
paragraph (a) of this subsection. 7
(5) A person receiving treatment under this section shall authorize the release of all 8
medical records, including the record of the evaluation completed under 9
subsection (4) of this section, relating to the medroxyprogesterone acetate 10
treatment to the Department of Corrections. 11
(6) Any person who intentionally violates this section may be reincarcerated for: 12
(a) The remaining p eriod of the person's initial sentence, if any is remaining; 13
and 14
(b) The entire period of postincarceration supervision or, if the initial sentence 15
has been served, for the remaining period of postincarceration supervision. 16
(7) The Department of Correction s shall promulgate administrative regulations in 17
accordance with KRS Chapter 13A to implement this section. 18
