AN ACT relating to poultry. 1
Be it enacted by the General Assembly of the Commonwealth of Kentucky: 2
SECTION 1. A NEW SECTION OF KRS 217.005 TO 217.215 IS CREATED 3
TO READ AS FOLLOWS: 4
(1) For the purposes of this section, "end consumer" means a person who is the last 5
person to purchase any food product and who does not resell the food product. 6
(2) Notwithstanding any other provision of law to the contrary, the secretary shall 7
promulgate administrative regulations in accordance with KRS Chapter 13A to: 8
(a) Exclude slaughtering and processing of poultry on a farm for the purpose 9
of conducting sales under 9 C.F.R. se c. 381.10 if the slaughtered and 10
processed poultry or poultry products are sold to an end consumer on a 11
farm, at a farmers market, or at a roadside stand; 12
(b) Require that poultry or poultry products processed under this section that 13
are sold on a farm be refrigerated at the point of sale and labeled in 14
compliance with the requirements of 9 C.F.R. sec. 381.10; and 15
(c) Require that poultry or poultry products pro cessed under this section that 16
are sold at a farmers market or at a roadside stand be frozen at the point of 17
sale and labeled in compliance with the requirements of 9 C.F.R. sec. 18
381.10. 19
(3) Notwithstanding any other provision of law to the contrary, a loc al governmental 20
agency shall not require any additional certification or inspection of poultry or 21
poultry products of a farmer acting in compliance with the administrative 22
regulations promulgated pursuant to this section. 23
