Delete original provisions; amend KRS 132.380 to require that a person pass an examination to receive a certification by the Department of Revenue; extend the expiration of certificates for candidates for the office of the property valuation administrator to 18 months from 12 months; require the department to work with the Kentucky Community and Technical College System (KCTCS) to prepare and administer an examination for qualifying a candidate for the office of the property valuation administrator; require the department to promulgate administrative regulations to incorporate a study guide and practice test for the examination; require the KCTCS to determine regional locations throughout the Commonwealth for holding the examination; set the timeframe for the initial examination period to be the first week in August to the second Friday in December in the year immediately preceding the first day a candidate is eligible to file for election to the office of property valuation administrator; set requirements for holding the examination and notifying the public about the examination; prohibit a person from taking the examination more than 2 times or more than once every 30 days; allow the county judge/executive to request up to 2 special examinations if no person received certification by the department; require any special examination requested to be held before the second Friday in December or until at least 1 person for that county is certified, whichever occurs first; prohibit a person from taking the special examination more than 2 times or more frequently than every 15 days; require the Department and the KCTCS to hold additional examinations if there is not a qualified candidate; require the department to promulgate administrative regulations for the rules of administrating and grading the examination; extend the retention of examination records to 18 months from 12 months; EMERGENCY.

AN ACT relating to local government. 1
Be it enacted by the General Assembly of the Commonwealth of Kentucky: 2
Section 1. KRS 132.380 is amended to read as follows: 3
(1) (a) 1. Except as provided in subparagraph 2. of this paragraph, before 4
a[any] person's name shall appear before the voters on election day as a 5
candidate for the office of property valuation administrator in any 6
primary or general election, [ except a current property valuation 7
administrator already qualified as a candidate to succeed himself or 8
herself in office,] or before that person may be appointed as a property 9
valuation administrator, the[except as an interim appointee as provided 10
by KRS 132.375, that] person shall hold a certificate issued by the 11
department[,] showing that he or she has been examined by the 12
department and is qualified for the office. 13
2. This section shall not apply to: 14
a. A current property valuation administrator already qualified as a 15
candidate to succeed himself or herself in office; or 16
b. An interim appointee as provided by KRS 132.375. 17
(b) All certificates issued shall expire one (1) year from the date of issuance. 18
(c) 1. The examinations shall be offered by the Kentucky Community and 19
Technical College System during the examination period. 20
2. The department shall provide the Kentucky Community and Technical 21
College System with the examination questions and other relevan t 22
information for administering the examination. 23
3. The examination questions [examinations] shall be written and 24
formulated so as to test fairly the ability and fitness of the applicant to 25
serve as a property valuation administrator. 26
(d) The examination period shall be open nine (9) months prior to the first day 27

a candidate is eligible to file for the office of property valuation 1
administrator and closed three (3) weeks before the candidate filing 2
deadline. 3
(e) The Kentucky Community and Technical College S ystem shall work with 4
the department to promulgate administrative regulations in accordance with 5
KRS Chapter 13A to establish the registration process and fees for the 6
examination[The department shall hold the examination at a central location 7
during the month of November of each year immediately preceding each year 8
in which property valuation administrators are to be elected]. 9
(f)[(e)] The department shall, at least thirty (30) days prior to the examination 10
period, issue a statewide press release announcin g the examination and post 11
the announcement on the department's website[Web site]. 12
[(f) Any person desiring to take an examination shall appear at the time and place 13
designated. 14
(2) (a) If, after the giving of the examination, as provided in subsection (1) of this 15
section, there is no person qualified to be a candidate in the county, the 16
department shall hold a second examination. 17
(b) Applicants from only those counties having no person qualified shall be 18
eligible to take the examination. 19
(c) Notice of the second examination shall be made by issuing a press release in 20
those counties and posting an announcement for the examination on the 21
department's Web site at least fourteen (14) days prior to the second 22
examination.] 23
(2)[(3)] [(a) ]If no qualified candidate files for the office, the department shall cause 24
a special examination to[shall] be given by the Kentucky Community and 25
Technical College System at a time determined by the department.[ 26
(b) ] Notice of[ and registration for] the special examination shall be issued in a 27

statewide press release and posted on the department's website at least thirty 1
(30) days prior to the special examination being held [provided in the same 2
manner as provided in subsection (2) of this section]. 3
(3)[(4)] (a) Whenever there is a vacancy in the office of property valuation 4
administrator to be filled by appointment or by election, and there is not more 5
than one (1) person holding a valid certificate and eligible for appointment or 6
election, the department shall cause[hold] a special examination to be held by 7
the Kentucky Community and Technical College System for applicants 8
seeking a certificate for the office. Notice of the special examination shall be 9
provided in the same manner as subsection (2) of this section. 10
(b) If only one (1) person is qualified [,] after the [ giving of a ] special 11
examination is held ,[ only one (1) person is qualified,] the county 12
judge/executive may request a second examination to be held by the 13
Kentucky Community and Technical College System. 14
[(c) ]Notice of [ and registration for] the second[special] examination shall be 15
issued in a statewide press release and posted on the department's website at 16
least thirty (30) days before t he second examination is held [provided in the 17
same manner as provided by subsection (2) of this section]. 18
(4)[(5)] (a) Examinations shall be given and graded in accordance with rules 19
created by[of] the department and published at the time of the examination. 20
(b) After a candidate completes the examination, the Kentucky Community and 21
Technical College System shall communicate to the department any 22
information necessary from the candidate's examination for the department 23
to determine whether the candidate pa ssed the examination. Within ten (10) 24
days of receipt of the information [after the examination] , a certificate of 25
fitness and qualification to fill the office of property valuation administrator 26
shall be issued by the department to the candidate if he or s he passed the 27

examination[each person passing the examination]. 1
(5)[(6)] Examination records shall be preserved by the department for twelve (12) 2
months after the examination, and the record of any person who took the 3
examination may be seen by him or her at the office of the department in Frankfort, 4
Kentucky. 5
