AN ACT relating to intercollegiate athletics in the Commonwealth. 1
Be it enacted by the General Assembly of the Commonwealth of Kentucky: 2
SECTION 1. A NEW SECTION OF KRS CHAPTER 164 IS CREATED TO 3
READ AS FOLLOWS: 4
(1) Due to the economic impact of intercollegiate athletics within the Commonwealth 5
and the United States, the General Assembly finds that certain regular 6
intercollegiate athletic competitions among the Commonwealth's public 7
universities enhance the profiles of these publicly supported programs and 8
promote economic activity within the Commonwealth. 9
(2) Each academic year, both the University of Louisville and the Universit y of 10
Kentucky shall endeavor to play against the public postsecondary institutions of 11
Eastern Kentucky University, Kentucky State University, Morehead State 12
University, Murray State University, Northern Kentucky University, and Western 13
Kentucky University in multiple sports. 14
(3) At a minimum, and during each academic year in which they field a team, the 15
University of Kentucky and the University of Louisville shall compete in an 16
intercollegiate sporting event against each other consisting of at least: 17
(a) One (1) sanctioned game of varsity-level football; and 18
(b) One (1) sanctioned game of varsity -level basketball for each of the men's 19
and women's teams to occur on or between December 14 and January 6. 20
(4) At a minimum, both the University of Kentucky and the University of Louisville 21
shall each play: 22
(a) Within a p eriod of two (2) academic years, one (1) sanctioned game of 23
varsity-level football against one (1) other Kentucky public postsecondary 24
institution; and 25
(b) During each academic year, two (2) sanctioned games of varsity -level 26
basketball for each of the men' s and women's teams against at least two (2) 27

other Kentucky public postsecondary institutions. 1
(5) A game scheduled to satisfy any requirement of subsection (3) or (4) of this 2
section may be subsequently postponed or cancelled due to or resulting from, in 3
whole or in part, acts or events beyond the control of the institutions, including 4
but not limited to acts of God, natural disasters, epidemics, strikes or other labor 5
disruptions, war, civil disturbances, riots, or complete or partial disruptions of 6
facilities. A game that is postponed and completed or a game that is cancelled 7
under this subsection shall satisfy any requirement of subsection (3) or (4) of this 8
section for the academic year. 9
Section 2. Notwithstanding Section 1 of this Act, if Section 1 of this Act would 10
violate any contract entered into by the University of Kentucky, the University of 11
Louisville, Eastern Kentucky University, Kentucky State University, Morehead State 12
University, Murray State University, No rthern Kentucky University, or Western 13
Kentucky University prior to this Act becoming law, then Section 1 of this Act shall not 14
be enforceable during the academic year governing that contract. 15
