AN ACT relating to reproduction. 1
Be it enacted by the General Assembly of the Commonwealth of Kentucky: 2
SECTION 1. A NEW SECTION OF KRS CHAPTER 216 IS CREATED TO 3
READ AS FOLLOWS: 4
(1) As used in this section: 5
(a) "Assisted reproductive technology" means all treatments or procedures 6
which include the handling of human oocytes or embryos, including in vitro 7
fertilization, gamete intrafallopian transfer, and zygote intrafallopian 8
transfer; and 9
(b) "Health care provider" means a health care facility or individual that is: 10
1. Engaged or seeks to engage in the delivery of assisted reproductive 11
technology, including through the provision of evidence -based 12
information, counseling, referrals, or items and services that relate to, 13
aid in, or provide fertility treatment; and 14
2. Licensed by the Kentucky Board of Medical Licensure under KRS 15
Chapter 311 or the Kentucky Board of Nursing under KRS Chapter 16
314. 17
(2) The Commonwealth or any of its political subdivisions shall not prohibit, 18
unreasonably limit, or interfere with the right of: 19
(a) An individual to access assisted reproductive technology; or 20
(b) A health care provider to perform or assist with the performance of assisted 21
reproductive technology treatments or procedures. 22
(3) This section shall not be construed to prohibit the enfor cement of health and 23
safety regulations related to the operation of health care facilities or providers. 24
SECTION 2. A NEW SECTION OF KRS CHAPTER 311 IS CREATED TO 25

of a human body shall not be considered an unborn child, a minor child, a natural 1
person, or any other term that connotes a human being for any purpose under state 2
law. 3
