AN ACT relating to the school-based Medicaid program. 1
Be it enacted by the General Assembly of the Commonwealth of Kentucky: 2
SECTION 1. A NEW SECTION OF KRS CHAPTER 160 IS CREATED TO 3
READ AS FOLLOWS: 4
(1) Beginning in the 2027-2028 school year, if a school district elects to: 5
(a) Provide healthcare services through a licensed or certified healthcare 6
professional, the school district shall bill the school -based Medicaid 7
program for medically necessary services provided to Medicaid enrolled 8
students for whom the district has obtained parental consent to bill; and 9
(b) Contract with a third -party billing vendor to bill the school -based Medicaid 10
program for covered services, the school district shall contract with a 11
vendor that has the capacity to submit Medicaid billing claims for all codes 12
listed in the current Medicaid Technical Assistance Guide, including all 13
codes within the scope of practice of nurse practitioners. 14
(2) (a) Notwithstanding any provision of law to the contrary, school nurses shall be 15
eligible to receive preventative oral health services training provided by the 16
Department for Public Health. 17
(b) School districts shall be permitted to bill for preventative oral health 18
services under the school -based Medicaid program when providing 19
preventative oral health services that are within the scope of practice of a 20
school nurse to Medicaid enrolled students for whom the district has 21
obtained parental consent to bill. 22
(c) Preventative oral health services provided under this subsection shall be: 23
1. Limited to services within the scope of practice for school nurses 24
established under KRS Chapter 314; and 25
2. Provided in accordance to protocols developed by the Department for 26
Public Health in consultation with the Kentucky Board of Dentistry. 27

(3) This section shall not: 1
(a) Apply to a school district that contracts with its local health department, a 2
federally qualified health center, or any other community -based provider 3
for school healthcare services; 4
(b) Be interpreted as requiring a school district to provide healthcare services 5
through a school nurse; 6
(c) Be construed or interpreted as modifying or superseding the school health 7
requirements established pursuant to KRS 156.16 0 and administrative 8
regulations promulgated thereunder; or 9
(d) Apply to a school that utilizes federal funds to employ a healthcare provider 10
to provide healthcare services to students. 11
