AN ACT relating to crimes and punishments. 1
Be it enacted by the General Assembly of the Commonwealth of Kentucky: 2
Section 1. KRS 501.030 is amended to read as follows: 3
A person is not guilty of a criminal offense unless: 4
(1) He or she has engaged in conduct which includes a voluntary act or the omission to 5
perform a duty which the law imposes upon him or he r and which he or she is 6
physically capable of performing; and 7
(2) He or she has engaged in such conduct intentionally, knowingly, wantonly or 8
recklessly as the law may require, with respect to each element of the offense, 9
except that this requirement doe s not apply to any offense which imposes absolute 10
liability, as defined in KRS 501.050. 11
