AN ACT relating to the protection of elected officials. 1
Be it enacted by the General Assembly of the Commonwealth of Kentucky: 2
SECTION 1. A NEW SECTION OF KRS CHAPTER 16 IS CREATED TO 3
READ AS FOLLOWS: 4
(1) As used in this section, "statewide-elected official" means any of the following: 5
(a) The Governor; 6
(b) The Lieutenant Governor; 7
(c) The Secretary of State; 8
(d) The Attorney General; 9
(e) The Auditor of Public Accounts; 10
(f) The State Treasurer; 11
(g) The Commissioner of Agriculture; 12
(h) A justice of the Supreme Court; 13
(i) A Court of Appeals judge; 14
(j) A Circuit Court judge; 15
(k) A District Court judge; 16
(l) A state senator of the General Assembly; or 17
(m) A state representative of the General Assembly. 18
(2) Upon receipt of a credible threat to kill or seriously injure a statewide -elected 19
official, the department or an agency designated by the department shall: 20
(a) Immediately investigate and conduct an assessment of the veracity of the 21
threat; and 22
(b) After the assessment, if it determines that the threat is a viable threat, 23
identify ways to mitigate or eliminate the threat by: 24
1. Working with local law enforcement; 25
2. Conducting arrests; 26
3. Providing security detail to the statewide -elected official who received 27

the threat; or 1
4. Any other mitigation tactics. 2
