  • A NEW SECTION OF KRS CHAPTER 7 IS CREATED TO 3 READ AS FOLLOWS: 4 (1) The Kentucky statewide health data utility is established in Sections 1 to 9 of this 5 Act to effectuate the following purposes: 6 (a) Create a seamless, transparent, and secure approach to health information 7 sharing and exchange among broad health care and he alth care 8 coordination settings that: 9 1.

AN ACT relating to the Kentucky statewide health data utility. 1
Be it enacted by the General Assembly of the Commonwealth of Kentucky: 2
Section 1. The staff of the Legislative Research Commission is directed to 3
conduct a study on the development of a Kentucky statewide health data utility. The 4
study shall analyze and provide: 5
(1) Policy options for establishing a Kentucky statewide health data utility that: 6
(a) Is the sole statewide network for the sharing and exchange of health 7
information; 8
(b) Aggregates health information received from participants; and 9
(c) Provides access, in a form and manner that ensures the privacy and security of 10
personal health information as required under federal and state law, to health information 11
in the statewide health data utility to authorized recipients for the purposes of: 12
1. Collecting and analyzing data to inform the authorized recipients as to health 13
care access, utilization, cost, safety, and quality in Kentucky; 14
2. Enabling health care professionals and health facilities to evaluate and 15
monitor care and treatment of patients; and 16
3. Enabling patients to access, through a technology enabled interface, the 17
patient's electronic longitudinal health record; 18
(2) Strategies for the direction and governance of the statewide health data utility 19
by and through the Legislative Research Commission; and 20
(3) Strategies for development of the statewide health data utility in a timely, 21
efficient, secure, sustainable, and cost-effective manner. 22
Section 2. In carrying out the duties in Section 1 of this Act, the Legislative 23
Research Commission may: 24
(1) Consult with officials and other entities in this state and other states to study 25
how they are engag ing in the development, implementation, and operation of health data 26
utilities and collection efforts; 27

(2) Retain a consultant or other vendor; and 1
(3) Convene a working group to inform and make recommendations to 2
Commission staff. 3
Section 3. A written report of staff findings, policy options, and strategies shall 4
be submitted to the Legislative Research Commission for referral to the Interim Joint 5
Committee on Health Services by December 1, 2026. 6
Section 4. Provisions of this Act to the contrary notwithstanding, the 7
Legislative Research Commission shall have the authority to alternatively assign the 8
issues identified herein to an interim joint committee or subcommittee thereof, and to 9
designate a study completion date. 10
Section 5. Sections 1 to 4 of this Act shall have the same legal status as a House 11
Concurrent Resolution. 12
