AN ACT relating to worker benefits. 1
Be it enacted by the General Assembly of the Commonwealth of Kentucky: 2
SECTION 1. A NEW SECTION OF KRS CHAPTER 336 IS CREATED TO 3
READ AS FOLLOWS: 4
(1) As used in this section: 5
(a) "Hiring party" means a person who hires or enters into a contract with a 6
self-employed worker; 7
(b) "Portable benefit plan" means a benefit plan that is provided by a third -8
party insurance provider chosen by a self -employed worker and assigned to 9
a beneficiary rather than to an employer or hiring party, including but not 10
limited to: 11
1. Health insurance; 12
2. Unemployment insurance; 13
3. Disability insurance; 14
4. Workers' compensation; 15
5. Life insurance; or 16
6. Retirement benefits; and 17
(c) "Self-employed worker" means a person who earns his or her living from 18
an independent pursuit of economic activities, rather th an from a separate 19
company or individual. 20
(2) A public or private entity, including an internet or application -based company, 21
may voluntarily contribute funds to a portable benefit plan as a form of 22
compensation to a self-employed worker. 23
(3) Contributions to a portable benefit plan shall not be used as criterion for 24
determining a worker's employment classification. 25
