  • A NEW SECTION OF KRS CHAPTER 164 IS CREATED TO 3 READ AS FOLLOWS: 4 (1) As used in this section: 5 (a) "Institution" means a public postsecondary education institution or the 6 entity designated by a public postsecondary educa tion institution to manage 7 student housing; and 8 (b) "Student housing" means a facility owned, leased, contracted, occupied, or 9 operated by an institution that is used to provide residential 10 accommodations to students of a public postsecondary education institution.
  • 11 (2) Beginning with the 2027 –2028 academic year, an institution that maintains a 12 requirement for designated students to reside in student housing shall: 13 (a) Establish a process through which a student may request an exemption 14 from a student housing requirement; 15 (b) Provide an exemption to a student who: 16 1.

Be it enacted by the General Assembly of the Commonwealth of Kentucky: 2
SECTION 1. A NEW SECTION OF KRS CHAPTER 164 IS CREATED TO 3
READ AS FOLLOWS: 4
(1) As used in this section: 5
(a) "Residential dual enrollment program" means a dual enrollment program 6
in which students of the program reside in student housing; and 7
(b) "Student housing" means a facility owned, leased, contracted, occupied, or 8
operated by a public postsecondary education institution that is used to 9
provide residential accommodations to students of the institution. 10
(2) Beginning with the 2027 -2028 academic year, a public postsecondary education 11
institution shall not require a student who is within six (6) months of attaining 12
the age of eighteen (18) years or older on the first day of a semester to: 13
(a) Reside in student housing; 14
(b) Pay a fine or fee for not residing in student housing; or 15
(c) Enter into a student housing contract or agreement as a condition of 16
admission, enrollment, or entry into any activity, course, program, or 17
service offered by the institution. 18
(3) This section shall not apply to: 19
(a) A student who is not more than seventeen (17) years and six (6) months of 20
age on the first day of a semester and whose parent or guardian has not 21
submitted written consent for the student to reside outside of student 22
housing; 23
(b) Residential dual enrollment programs; or 24
(c) The model and practice school under KRS 164.380. 25
