AN ACT relating to Medicaid eligibility. 1
Be it enacted by the General Assembly of the Commonwealth of Kentucky: 2
Section 1. KRS 205.592 is amended to read as follows: 3
(1) Except as provided in subsection (2) of this section, pregnant women, new 4
parents[mothers] up to twenty-four (24) [twelve (12)] months postpartum, and 5
children up to age one (1) shall be el igible for participation in the Kentucky 6
Medical Assistance Program if: 7
(a) They have family income up to but not exceeding one hundred and eighty-five 8
percent (185%) of the nonfarm income official poverty guidelines as 9
promulgated by the United States Department of Health and Human Services 10
[of the United States ]as revised annually; and 11
(b) They are otherwise eligible for the program. 12
(2) The percentage established in subsection (1)(a) of this section may be increased to 13
the extent: 14
(a) Permitted under federal law; and 15
(b) Funding is available. 16
Section 2. If the Cabinet for Health and Family Services or t he Department for 17
Medicaid Services determines that a state plan amendment, waiver, or any other form of 18
authorization or approval from any federal agency to implement Section 1 of this Act is 19
necessary to prevent the loss of federal funds or to comply wit h federal law, the cabinet 20
or department: 21
(1) Shall, within 90 days after the effective date of this section, request the 22
necessary federal authorization or approval to implement Section 1 of this Act; and 23
(2) May only delay implementation of the provision s of Section 1 of this Act for 24
which federal authorization or approval was deemed necessary until the federal 25
authorization or approval is granted. 26
Section 3. Sections 1 and 2 of this Act shall constitute the specific au thorization 27
