AN ACT relating to collective bargaining agreements. 1
Be it enacted by the General Assembly of the Commonwealth of Kentucky: 2
SECTION 1. A NEW SECTION OF KRS CHAPTER 160 IS CREATED TO 3
READ AS FOLLOWS: 4
(1) As used in this section: 5
(a) "Bargain collectively" means to carry out in good faith the mutual 6
obligation of the parties, or their representatives, to: 7
1. Meet at rea sonable times, including meetings in advance of the 8
budget-making process; 9
2. Negotiate in good faith with respect to wages, hours, and other 10
conditions of employment; 11
3. Negotiate an agreement; 12
4. Negotiate any question arising under any agreement; and 13
5. Execute a written contract incorporating any agreement reached. 14
The obligation shall not be interpreted to compel either party to agree to a 15
proposal or require either party to make a concession; and 16
(b) "Local association" means any organization that acts as a representative 17
for members employed by a school or school district. 18
(2) A local board of education and any local association shall bargain collectively in 19
pursuit of a collective bargaining agreement between a local board of education 20
and any local association that represents the interests of school employees or 21
personnel. 22
(3) A local board of education or local association found in violation of subsection 23
(2) of this section by a court of co mpetent jurisdiction shall owe to the aggrieved 24
party an amount not to exceed five hundred dollars ($500). 25
