AN ACT relating to the General Assembly. 1
Be it enacted by the General Assembly of the Commonwealth of Kentucky: 2
SECTION 1. A NEW SECTION OF KRS CHAPTER 7 IS CREATED TO 3
READ AS FOLLOWS: 4
(1) The Special Committee on Sexual Misconduct is hereby established as an 5
independent authority and shall be attached to the Legislative Research 6
Commission for administrative purposes only. 7
(2) The committee shall be composed of the following eight (8) members: 8
(a) Three (3) members of the Senate, appointed by the President of the Senate; 9
(b) One (1) member of the Senate, appointed by the Minority Floor Leader of 10
the Senate; 11
(c) Three (3) members of the House of Representatives, appointed by the 12
Speaker of the House of Representatives; and 13
(d) One (1) member of the House of Representatives, app ointed by the Minority 14
Floor Leader of the House of Representatives. 15
(3) The committee shall: 16
(a) Receive and investigate complaints submitted by an employee of the 17
Legislative Research Commission or a member of the public alleging that a 18
member of the Gen eral Assembly has committed sexual harassment, sexual 19
abuse, or sexual assault against: 20
1. An employee of the Legislative Research Commission; 21
2. Another member of the General Assembly; or 22
3. A member of the public; 23
(b) Upon completion of its investigation, but no later than ninety (90) days after 24
receipt of a complaint submitted in accordance with paragraph (a) of this 25
subsection, submit a report of its findings and any recommended punitive 26
actions to be taken, if any, to the: 27

1. President of the Senate an d all members of the Senate, if the alleged 1
violator is a member of the Senate; or 2
2. Speaker of the House of Representatives and all members of the 3
House of Representatives, if the alleged violator is a member of the 4
House of Representatives; 5
(c) Conduct a hearing in accordance with KRS Chapter 13B if, upon 6
completion of its investigation, the committee finds that the member of the 7
General Assembly may have committed sexual harassment, sexual abuse, or 8
sexual assault alleged in paragraph (a) of this subsection; and 9
(d) Recommend punitive actions, if after the hearing the committee finds that a 10
member of the General Assembly has committed a violation. The committee 11
shall recommend to the President of the Senate or the Speaker of the House 12
of Representatives, as appropriate, punitive actions which may include but 13
not be limited to: 14
1. Removal from committees to which the member of the General 15
Assembly has been assigned; 16
2. Denial of access to employees of the Legislative Research Commission 17
affected by the conduct; 18
3. Denial of access to certain parts of the New State Capitol, New Capitol 19
Annex, or any temporary buildings in use by the General Assembly; 20
4. Imposition of fines; 21
5. Initiation of a vote of the applicable body for expulsion of the 22
member; or 23
6. Any other penalty the committee deems appropriate. 24
(4) The complaint and any records resulting from the investigation under this section 25
shall be exempt from the Open Records Act, KRS 61.870 to 61.884. 26
(5) Any records that identify the complainant or a witne ss shall be confidential and 27

redacted from any final reports. Personally identifiable information pertaining to 1
the complainant or any witnesses shall be exempt from the Open Records Act, 2
KRS 61.870 to 61.884. 3
