AN ACT relating to harassing communications. 1
Be it enacted by the General Assembly of the Commonwealth of Kentucky: 2
Section 1. KRS 525.080 is amended to read as follows: 3
(1) A person is guilty of harassing communications when [, with intent to intimidate, 4
harass, annoy, or alarm another person,] he or she: 5
(a) Sends repeated electronic or telephonic communications in a manner that is 6
reasonably likely to harass, annoy, alarm, torment, embarrass, or offend 7
another and serves no purpose of legitimate communication [Communicates 8
with a person, anonymously or otherwise, by telephone, telegraph, mail, or 9
any other for m of electronic or written communication in a manner which 10
causes annoyance or alarm and serves no purpose of legitimate 11
communication]; 12
(b) Publishes to social media or any internet website repeated electronic or 13
telephonic communications in a manner that is reasonably likely to cause 14
emotional distress, abuse, or torment to another person and serves no 15
purpose of legitimate communication[Makes a telephone call, whether or not 16
conversation ensues, with no purpose of legitimate communication]; or 17
(c) Communicates, while enrolled as a student in a local school district, with or 18
about another school student, anonymously or otherwise, by telephone, the 19
internet, telegraph, mail, or any other form of electronic or written 20
communication in a manner which a reasonable person under the 21
circumstances should know would cause the other student to suffer fear of 22
physical harm, intimidation, humiliation, or embarrassment and which serves 23
no purpose of legitimate communication. 24
(2) Harassing communications is a Class A[B] misdemeanor. 25
