A CONCURRENT RESOLUTION urging the creation of an interstate compact for 1
a competitive electric transmission market using competitive bidding. 2
WHEREAS, anticompetitive policies in some states constrain efforts to modernize 3
and expand energy transmission assets; and 4
WHEREAS, these policies have hindered infrastructure growth and increased 5
transmission costs to ratepayers because the noncompetitive nature of the perm itting and 6
siting process of transmission projects does not incentivize the reduction of costs or 7
optimization of benefits; and 8
WHEREAS, some of the most popular, anticompetitive laws discriminate against 9
out-of-state businesses, which may violate the comm erce clause of the United States 10
Constitution; and 11
WHEREAS, market -led consumer demand for better products and services has 12
precipitated an increased need for power generation in the United States; and 13
WHEREAS, to maintain a viable and growing economy, ens ure a secure and 14
reliable power supply in the United States, and promote economic prosperity for the 15
citizens of the Commonwealth, the transmission capacity of the current utility 16
infrastructure must be modernized and expanded in a way that is responsive t o the needs 17
and demands of both citizens and businesses; 18
NOW, THEREFORE, 19
Be it resolved by the House of Representatives of the General Assembly of the 20
Commonwealth of Kentucky, the Senate concurring therein: 21
Section 1. The General Assembly calls for the creation of an interstate compact 22
for the development of a competitive electric transmission market that would: 23
(1) Be in the best interests of the electric utility ratepayer and the 24
Commonwealth's economy; 25
(2) Deploy the requisite technologies to enhance and modernize the transmission 26
grid; and 27

(3) Improve the electric transmission grid's capacity to transport electric energy 1
while preventing transmission bottlenecks and congestion. 2
Section 2. Any interstate compact for the development of a competitive electric 3
transmission market should: 4
(1) Use uniform rules, requirements, and procedures for the permitting and siting 5
of transmission lines, upgrading or reconducto ring of the transmission infrastructure, and 6
deploying grid -enhancing technologies across states within a regional transmission 7
organization for all types of electric generating units, regardless of the fuel or electric 8
generating technology used; 9
(2) Allocate costs in an unbiased, holistic manner to all beneficiaries of the 10
competitive transmission market; 11
(3) Streamline all permits and regulatory reviews when deploying innovative 12
grid-enhancing technologies; 13
(4) Open the bidding process to interstate transmission projects; 14
(5) Eliminate redundancies or instances of double permitting for different 15
intragovernmental units in the transmission siting and permitting process; 16
(6) Develop and prioritize what would be known as co -location superhighways 17
for stream lined permitting and coordinated infrastructure development projects when 18
possible; and 19
(7) Apply the compact equally to all states upon each legislature's adoption of the 20
compact. 21
Section 3. The Clerk of the House of Re presentatives is directed to transmit a 22
copy of this Resolution to the Governor and the commissioners of the Public Service 23
Commission. 24
