A CONCURRENT RESOLUTION establishing the Charitable Gaming 1
Modernization Task Force to study, review, and report on updates to Kentucky’s 2
charitable gaming statutes and administrative regulations. 3
WHEREAS, charitable gaming has long served as a critical fundraising mechanism 4
for nonprofit organizations throughout the Commonwealth, including faith -based 5
organizations, public and private schools, veterans’ organizatio ns, volunteer fire 6
departments, fraternal organizations, and other charitable and civic entities; and 7
WHEREAS, proceeds from charitable gaming support essential community 8
services, charitable missions, and public -benefit activities that would otherwise req uire 9
additional public or private funding; and 10
WHEREAS, Kentucky’s charitable gaming framework is governed primarily by 11
KRS Chapters 230 and 238 and their accompanying administrative regulations, which 12
together comprise an extensive, highly technical, and complex regulatory scheme; and 13
WHEREAS, recent organizational and structural changes to the oversight of 14
charitable gaming within state government underscore the importance of ensuring that 15
Kentucky’s statutory and regulatory framework is clear, coherent, and aligned with 16
modern administrative practices; and 17
WHEREAS, a thoughtful review of charitable gaming laws and administrative 18
regulations may identify opportunities to responsibly enhance charitable revenues while 19
maintaining strong safeguards for integrity, transparency, accountability, and public trust, 20
and may assist policymakers in clearly distinguishing lawful charitable gaming from 21
unlawful or unregulated activities; 22
NOW, THEREFORE, 23
Be it resolved by the House of Representatives of the General Assem bly of the 24
Commonwealth of Kentucky, the Senate concurring therein: 25
Section 1. The Legislative Research Commission is hereby directed to establish 26
the Charitable Gaming Modernization Task Force. The task force shall study Kentucky’s 27

charitable gaming laws and administrative regulations and accomplish the following: 1
(1) Complete a comprehensive statutory and regulatory review identifying 2
redundancies, inconsistencies, and obsolete provisions within KRS Chapters 230 and 238 3
and their associated administrative regulations; 4
(2) Consider stakeholder input from licensed charitable organ izations across 5
multiple categories, including faith -based, educational, veterans, public safety, and other 6
nonprofit entities; 7
(3) Compare charitable gaming regulatory frameworks in peer or similarly 8
situated states; 9
(4) Review administrative and technol ogical processes related to charitable 10
gaming licensure; and 11
(5) Recommend statutory or regulatory changes, as appropriate. 12
Section 2. The Charitable Gaming Modernization Task Force shall consist of 13
the following ten mem bers, with final membership of the task force being subject to the 14
consideration and approval of the Legislative Research Commission: 15
(1) Four members of the House of Representatives appointed by the Speaker of 16
the House of Representatives, one of whom sha ll be designated by the Speaker of the 17
House of Representatives as a co-chair of the task force; 18
(2) One member of the House of Representatives appointed by the Minority Floor 19
Leader of the House of Representatives; 20
(3) Four members of the Senate appointed by the President of the Senate, one of 21
whom shall be designated by the President of the Senate as a co -chair of the task force; 22
and 23
(4) One member of the Senate appointed by the Minority Floor Leader of the 24
Senate. 25
Section 3. The Charitable Gaming Modernization Task Force shall meet at least 26
four times during the 2026 Interim and shall submit its findings, legislative 27

recommendations, or a memorandum to the Legislative Research Commission no later 1
than December 1, 2026. If legislative recommendations are submitted, the Legislative 2
Research Commission may refer the recommendations to the appropriate committee or 3
committees of jurisdiction in advance of the 2027 Regular Session of the Kentucky 4
General Assembly. 5
Section 4. Provisions of this Resolution to the contrary notwithstanding, the 6
Legislative Research Commission shall have the authority to alternatively assign the 7
issues identified herein to an interim joint committee or subcommitte e thereof, and to 8
designate a study completion date. 9
