A CONCURRENT RESOLUTION calling on the United States Congress to submit 1
to the states for ratification a balanced budget amendment to the United States 2
Constitution and making a formal application to Congress under Article V of the United 3
States Constitution to call a convention for the sole purpose of proposing for ratification 4
an amendment to the United States Constitution which requires a balanced federal 5
budget. 6
WHEREAS, the United States Congress has run up a debt so massive that it has 7
endangered the U.S. Government, the U.S. economy, U.S. national defense, and all fifty 8
States; and 9
WHEREAS, Article V of the Constitution of the United States mandates that upon 10
the "Application of the Legislatures of two -thirds of the several States," Congress shall 11
"call a Convention for proposing Amendments"; and 12
WHEREAS, historically, when the States have come within one application of the 13
two-thirds (thirty-four) necessary to call a convention to propose a specific amendment, 14
Congress has acted to propose said amendment in order to prevent a convention from 15
being called; and 16
WHEREAS, President Ronald Reagan advocated the use of this "thirty -three state 17
strategy" to pressure Congress to propose a Balanced Budget Amendment for ratification 18
by the States; and 19
WHEREAS, the legislature deems an amendment to the United States Constitution 20
requiring a balanced federal budget is necessary for the good of the American people; 21
NOW, THEREFORE, 22
Be it resolved by the House of Representatives of the General Assembly of the 23
Commonwealth of Kentucky, the Senate concurring therein: 24
Section 1. The Kentucky General Assembly applies to Congress, under the 25
provisions of Article V of the Constitution of the United States, for the calling of a 26
convention of the states limited to proposing an amendment to the Constitution of the 27

United States requiring that in the absence of a national emergency the total of all federal 1
outlays made by the Congress for any fiscal year may not exceed the total of all estimated 2
federal revenues for that fiscal year, together with any related and appropriate fiscal 3
restraints. 4
Section 2. The clerk of the House of Representatives is directed to transmit 5
copies of this Resolution to the President of the United States; the Secretary of the United 6
States Senate; the Speaker and Clerk of the United States House of Representatives; the 7
members of the United States Senate and the United States House of Representatives 8
from this Commonwealth; and 9
The presiding officers of each of the legislative houses in the several states, 10
requesting their cooperation in this endeavor. 11
Section 3. This application constitutes a continuing application in accordance 12
with Article V of the Constitution of the United States until the legislatures of at least 13
two-thirds of the several states have made applications on the same subject. It supersedes 14
all previous applications by this legislature on the same subject. 15
