A JOINT RESOLUTION directing the establishment of the Real Estate 1
Modernization Task Force. 2
WHEREAS, the General Assembly has not updated many of Kentucky's real 3
property laws since the statute laws of this Commonwealth were codified in the Kentucky 4
Revised Statutes; and 5
WHEREAS, the General Assembly wishes to examine ways in which the real 6
property laws of the Commonwealth may be updated and modernized to best serv e 7
Kentuckians; 8
NOW, THEREFORE, 9
Be it resolved by the General Assembly of the Commonwealth of Kentucky: 10
Section 1. The Legislative Research Commission is directed to establish the 11
Real Estate Modernization Task Force. The task force shall: 12
(1) Study methods and approaches to protect against fraud in real estate 13
transactions; 14
(2) Conduct a review of the real property laws of the Commonwealth and identify 15
any areas for modernization; and 16
(3) Study any other topic or issue relating to real property or housing that the task 17
force determines is appropriate. 18
Section 2. The Real Estate Modernization Task Force shall be composed of the 19
following members, with fina l membership of the task force being subject to the 20
consideration and approval of the Legislative Research Commission: 21
(1) Four members of the House of Representatives, including three members 22
appointed by the Speaker of the House of Representatives, one o f whom shall be 23
designated to serve as co-chair, and one member appointed by the Minority Floor Leader 24
of the House of Representatives; 25
(2) Four members of the Senate, including three members appointed by the 26
President of the Senate, one of whom shall be d esignated to serve as co -chair, and one 27

member appointed by the Minority Floor Leader of the Senate; 1
(3) The Attorney General; 2
(4) The secretary of the Public Protection Cabinet; 3
(5) One member representing the Kentucky County Clerks Association; 4
(6) One member representing the Kentucky Association of Realtors; 5
(7) One member representing mortgage brokers; and 6
(8) One member representing title companies. 7
Section 3. The Real Estate Modernization Task Force shall meet at le ast 8
monthly during the 2026 Interim of the General Assembly and shall submit its findings, 9
legislative recommendations, or a memorandum to the Legislative Research Commission 10
no later than December 1, 2026. If legislative recommendations are submitted, the 11
Legislative Research Commission may refer the recommendations to the appropriate 12
committee or committees of jurisdiction in advance of the 2027 Regular Session of the 13
General Assembly. 14
