AN ACT relating to massage therapy. 1
Be it enacted by the General Assembly of the Commonwealth of Kentucky: 2
Section 1. KRS 309.364 is amended to read as follows: 3
(1) Except as provided in subsection (2) of this section, KRS 309.350 to 309.364 4
supersede all ordinances or regulations regulating massage therapists in any city, 5
county, urban -county, unified local government, charter county, or consolidated 6
local government. 7
(2) Nothing in this section shall be interpreted or construed to limit the authority of 8
cities, counties, urban -county governments, consolidated local governments, 9
unified local governme nts, or charter county governments from regulating the 10
operation of businesses that are, or advertise to be, owned, operated, associated, 11
or affiliated with a licensed massage therapist, including the authority to adopt 12
and enforce ordinances or regulations relating to: 13
(a) Zoning requirements; 14
(b) Local business or occupational licensing requirements and standards; 15
(c) Occupational license fee; or 16
(d) Inspection, advertising, hours of operation, and sanitation 17
requirements[This article does not affect city, county, urban -county, charter 18
county, or consolidated local government regulations relating to zoning 19
requirements or occupational license fees pert aining to health care 20
professions]. 21
Section 2. KRS 309.3535 is amended to read as follows: 22
Any person who violates KRS 309.353 shall be guilty of a Class A[B] misdemeanor. 23
Each massage performed without a license shall constitute a separate offense. 24
