AN ACT relating to the forensic processing of firearms. 1
Be it enacted by the General Assembly of the Commonwealth of Kentucky: 2
SECTION 1. A NEW SECTION OF KRS CHAPTER 15 IS CREATED TO 3
READ AS FOLLOWS: 4
(1) When a law enforcement agency seizes or recovers a firearm that was unlawfully 5
possessed, used for any unlawful purpose, recovered from the scene of a crime, is 6
reasonably believed to have been used or associated with the commission of a 7
crime, or is acquired by the agency as an abandoned or discarded firearm, the 8
agency shall: 9
(a) Transmit to and receive from the United States Alcohol, Tobacco, Firearms 10
and Explosives e Trace system and the National Crime Information Center 11
system information relating to that firearm; and 12
(b) Arrange for every such firearm to be test -fired as soon as practicable and 13
the results of that test -firing be submitted to the National Integrated 14
Ballistic Information Network to determine whether the firearm is 15
associated with or related to a crime, criminal conduct, any individual 16
associated with or related to a crime or criminal conduct, or reasonably 17
believed to be associated with or related to a crime or criminal conduct. 18
(2) When a law enforcement agency recovers any spent shell casing at a crime scene 19
or has reason to believe that a recovered spent shell casing is associated with or 20
related to the commission of a crime or the unlawful discharge of a firearm, the 21
agency shall, as soon as practicable, submit the ballistics information to the 22
National Integrated Ballistic Information Network. 23
(3) Local law enforcement agencies shall develop policies and procedures, approved 24
by the Justice and Public Safety Cabinet, for the recove ry and forensic processing 25
of firearms and firearm -related evidence where a firearm was unlawfully 26
possessed, used for any unlawful purpose, recovered from the scene of a crime, 27

reasonably believed to have been used or associated with the commission of a 1
crime, or acquired by the agency as an abandoned or discarded firearm. 2
