AN ACT relating to regulation of occupancies by local governments. 1
Be it enacted by the General Assembly of the Commonwealth of Kentucky: 2
SECTION 1. A NEW SECTION OF KRS CHAPTER 65 IS CREATED TO 3
READ AS FOLLOWS: 4
(1) A city, county, charter county government, urban -county government, unified 5
local government, consolidated local government, or special district shall not 6
adopt or enf orce any ordinance, regulation, or other rule that restricts the 7
occupancy of any dwelling unit: 8
(a) To less than two (2) occupants per bedroom; or 9
(b) Based on the familial or nonfamilial relationship or marital status among 10
the occupants. 11
(2) This section shall not be construed to affect a local government's ability to 12
enforce the state building code or any uniform code or administrative regulation 13
related to fire safety or the construction or safety of buildings. 14
