AN ACT relating to deficient administrative regulations and declaring an 1

Be it enacted by the General Assembly of the Commonwealth of Kentucky: 3
SECTION 1. A NEW SECTION OF KRS CHAPTER 13A IS CREATED TO 4
READ AS FOLLOWS: 5
(1) The General Assembly finds that the proposed ordinary amendment to 907 KAR 6
23:010, Outpatient Pharmacy Program, was found deficient pursuant to KRS 7
13A.030, on or after March 28, 2025, and before April 15, 2026, as evidenced by 8
the records of the Legislative Research Commission. 9
(2) Contrary provisions of any section of the Kentucky Revised Statutes 10
notwithstanding: 11
(a) If the proposed ordinary amendment referenced in subsection (1) of this 12
section has not been adopted on or before the effective date of thi s Act, the 13
proposed ordinary amendment shall expire as of the effective date of this 14
Act; or 15
(b) If the proposed ordinary amendment referenced in subsection (1) of this 16
section has been adopted on or before the effective date of this Act, the 17
administrative regulation, including any subsequently filed amendments, 18
shall be null, void, and unenforceable as of the effective date of this Act. 19
(3) Contrary provisio ns of any section of the Kentucky Revised Statutes 20
notwithstanding, the administrative body shall be prohibited from promulgating 21
an administrative regulation that is identical to, or substantially the same as, the 22
proposed amendment referenced in subsecti on (1) of this section for a period 23
beginning on January 6, 2026, and concluding on June 1, 2027. 24
(4) The proposed amendment referenced in subsection (1) of this section shall be 25
available to the public, in the office of the Legislative Research Commission 's 26
regulations compiler. 27

regulations were found deficient pursuant to KRS 13A.030, on or after March 28, 4
2025, and before April 15, 2026, as evidenced by the records of the Legislative 5
Research Commission: 6
(a) 804 KAR 13:020 and Emergency, Tobacco, nicotine, or vapor product 7
license application forms; and 8
(b) 804 KAR 13:030 a nd Emergency, Causes for denial of tobacco, nicotine, or 9
vapor product license. 10
(2) Contrary provisions of any section of the Kentucky Revised Statutes 11
notwithstanding, the proposed administrative regulations referenced in 12
subsection (1) of this section sh all be null, void, and unenforceable as of the 13
effective date of this Act. 14
(3) Contrary provisions of any section of the Kentucky Revised Statutes 15
notwithstanding, the administrative body shall be prohibited from promulgating 16
administrative regulations tha t are identical to, or substantially the same as, the 17
proposed administrative regulations referenced in subsection (1) of this section 18
for a period beginning on January 6, 2026, and concluding on June 1, 2027. 19
(4) The proposed administrative regulations re ferenced in subsection (1) of this 20
section shall be available to the public, in the office of the Legislative Research 21
Commission's regulations compiler. 22
SECTION 3. A NEW SECTION OF KRS CHAPTER 13A IS CREATED TO 23

(1) The General Assembly finds that the following proposed administrative 25
regulations were found deficient pursuant to KRS 13A.030, on or after March 28, 26
2025, and before April 15, 2026, as evidenced by the records of the Legislative 27

(a) 601 KAR 9:120 and Emergency, Accessible online insurance verification 2
system; 3
(b) 902 KAR 55:110, Monitoring system for prescription controlled substances; 4
and 5
(c) 922 KAR 1:565, Service array for a relative or fictive kin caregiver. 6
(2) Contrary provisions of any section of the Kentucky Revised Statutes 7
notwithstanding, the proposed administrative regulations referenced in 8
subsection (1) of this section shall be null, void, and unenforceable as of the 9
effective date of this Act. 10
(3) Contrary pr ovisions of any section of the Kentucky Revised Statutes 11
notwithstanding, the administrative body shall be prohibited from promulgating 12
administrative regulations that are identical to, or substantially the same as, the 13
proposed administrative regulations referenced in subsection (1) of this section 14
for a period beginning on January 6, 2026, and concluding on June 1, 2027. 15
(4) The proposed administrative regulations referenced in subsection (1) of this 16
section shall be available to the public, in the office of the Legislative Research 17
Commission's regulations compiler. 18
Section 4. Whereas it is crucial that the Commonwealth's regulatory policy 19
reflect the statutory intent of the General Assembly, an emergency is declared to exist, 20
and this Act takes effect upon its passage and approval by the Governor or upon its 21
otherwise becoming a law. 22
