AN ACT relating to executive branch agencies. 1
Be it enacted by the General Assembly of the Commonwealth of Kentucky: 2
Section 1. KRS 148.280 is amended to read as follows: 3
(1) The commission: 4
(a) Shall have the authority and control of such property as now is under its 5
custody and control, and of such property as may hereafter be placed under it s 6
control or transferred to it by the State Property and Buildings Commission, 7
for any purpose mentioned in this section; 8
(b) May erect and repair buildings on the Kentucky Horse Park and make any and 9
all necessary or proper improvements, and generally car ry on a program of 10
development and extension of facilities designed to accomplish the objectives 11
defined in this section; and 12
(c) Shall promote the progress of the state and stimulate public interest in the 13
advancement and development of the state by providing the facilities of the 14
Kentucky Horse Park for exhibitionary, competitive, and other events relative 15
to various aspects of the horse industry and other functions calculated to 16
advance and enhance the tourist industry, economy, entertainment, cultural, 17
and educational interests of the public. 18
(2) The commission may take, acquire, and hold property, and all interest herein, by 19
deed, gift, devise, bequest, lease, or by transfer from the state property so acquired 20
in the manner provided by law, and may dispose of any property so acquired in the 21
manner provided by law. 22
(3) The commission may promulgate administrative regulations in acc ordance with 23
KRS Chapter 13A to govern the operation, maintenance, or use of property under 24
its custody and control, as are necessary to: 25
(a) Maintain decency and good order; 26
(b) Protect the peace or safety of the general public; 27

(c) Protect the public interest, convenience, or necessity;[ and] 1
(d) Govern the operation, maintenance, or use of the Kentucky Horse Park; and 2
(e) Exercise the authority granted in subsection (4)(d) of this section. 3
(4) The commission may: 4
(a) Employ or contract with other persons , firms, or corporations the commission 5
may deem necessary or desirable to accomplish its duties and functions; may 6
fix the compensation and the terms of employment or contract of those 7
employed or contracted with; and may assign to them duties and 8
responsibilities the commission may determine, including the responsibility of 9
actual operation of any or all of the facilities under the control of the 10
commission; 11
(b) Purchase liability insurance for the members and executive officers exempted 12
from the classified service of the state by KRS 18A.115;[ and] 13
(c) Operate shows and expositions that support the purpose and function of the 14
Kentucky Horse Park; and 15
(d) Through the president, eject or exclude from Kentucky Horse Park property 16
any person who engages or ha s engaged in conduct that would negatively 17
impact the safety and security of park attendees. 18
Section 2. KRS 42.740 is amended to read as follows: 19
(1) There is hereby established a Geographic Information Advisory Council, attached 20
to the Commonwealth Office of Technology for administrative purposes, to advise 21
the executive director of the Commonwealth Office of Technology on issues 22
relating to geographic information and geographic information systems. 23
(2) The council shall recommend policies and procedures that assist state and local 24
jurisdictions in developing, deploying, and leveraging geographic information 25
resources and geographic information systems technology for the purpose of 26
improving public administration. 27

(3) The council shall closely coordinate with users of geographic information systems 1
to recommend policies and procedures that ensure the maximum use of geographic 2
information by minimizing the redundancy of geographic information and 3
geographic information reso urces, as well as to ensure that the geographic 4
information clearinghouse maintained by the Division of Geographic Information 5
Systems meets the needs of all state agencies. 6
(4) (a) The Geographic Information Advisory Council shall consist of twenty -five 7
(25) members and one (1) legislative liaison. The members shall be 8
knowledgeable in the use and application of geographic information systems 9
technology and shall have sufficient authority within their organizations to 10
influence the implementation of council recommendations. 11
(b) The council shall consist of: 12
1. The secretary of the Transportation Cabinet or his or her designee; 13
2. The secretary of the Cabinet for Health and Family Services or his or 14
her designee; 15
3. The director of the Kentucky Geological Survey or his or her designee; 16
4. The secretary of the Finance and Administration Cabinet or his or her 17
designee; 18
5. The executive director of the Commonwealth Office of Technology or 19
her or his designee, who shall serve as chair; 20
6. The secretary of the Eco nomic Development Cabinet or his or her 21
designee; 22
7. The commissioner of the Department for Local Government or his or 23
her designee; 24
8. The secretary of the Justice and Public Safety Cabinet or his or her 25
designee; 26
9. One (1) member appointed by the Governor from a list of three (3) 27

persons submitted by the president of the Council on Postsecondary 1
Education; 2
10. The adjutant general of th e Department of Military Affairs or his or her 3
designee; 4
11. The commissioner of the Department of Education or his or her 5
designee; 6
12. The secretary of the Energy and Environment Cabinet or his or her 7
designee; 8
13. The Commissioner of the Department of A griculture or his or her 9
designee; 10
14. The secretary of the Tourism, Arts and Heritage Cabinet or his or her 11
designee; 12
15. The executive director of the Office of Property Valuation or his or her 13
designee; 14
16. One (1) member appointed by the Governor from a list of three (3)[six 15
(6)] persons submitted by the president of the Kentucky League of 16
Cities; 17
17. One (1) member appointed by the Governor from a list of three (3)[six 18
(6)] persons submitted by the president of the Kentucky Association of 19
Counties; 20
18. One (1) member appointed by the Governor from a list of three (3) 21
persons submitted by the president of the Kentucky Chapter of the 22
American Planning Association; 23
19. One (1) member appointed by the Governor from a list of three (3) 24
persons submitted by t he president of the Kentucky Association of 25
Professional Surveyors; 26
20. One (1) member appointed by the Governor from a list of three (3) 27

persons submitted by the president of the Kentucky Society of 1
Professional Engineers; 2
21. One (1) member appointed by the Governor from a list of three (3) 3
persons submitted by the chairman of the Kentucky Board of Registered 4
Geologists; 5
22. One (1) member appointed by the Governor from a list of three (3) 6
persons submitted by the president of the Council of Area Developm ent 7
Districts; 8
23. One (1) member appointed by the Governor from a list of three (3) 9
persons submitted by the president of the Kentucky Association of 10
Mapping Professionals; 11
24. One (1) member appointed by the Governor from a list of three (3) 12
persons sub mitted by the executive director of the Kentucky Property 13
Valuation Administrators Association; and 14
25. The executive director of the Kentucky Office of Homeland Security. 15
(c) The council shall have one (1) nonvoting legislative liaison, to be appointed 16
by the Legislative Research Commission. 17
(5) The council may have committees and subcommittees as determined by the council 18
or an executive committee, if an executive committee exists. 19
(6) A member of the council shall not: 20
(a) Be an officer, employee, or pai d consultant of a business entity that has, or of 21
a trade association for business entities that have, a substantial interest in the 22
geographic information industry and is doing business in the Commonwealth; 23
(b) Own, control, or have, directly or indirectl y, more than ten percent (10%) 24
interest in a business entity that has a substantial interest in the geographic 25
information industry; 26
(c) Be in any manner connected with any contract or bid for furnishing any 27

governmental body of the Commonwealth with geogr aphic information 1
systems, the computers on which they are automated, or a service related to 2
geographic information systems; 3
(d) Be a person required to register as a lobbyist because of activities for 4
compensation on behalf of a business entity that has, or on behalf of a trade 5
association of business entities that have, substantial interest in the geographic 6
information industry; 7
(e) Accept or receive money or another thing of value from an individual, firm, or 8
corporation to whom a contract may be award ed, directly or indirectly, by 9
rebate, gift, or otherwise; or 10
(f) Be liable to civil action or any action performed in good faith in the 11
performance of duties as a council member. 12
(7) Those council members specified in subsection (4) (b)[(a)] of this section who serve 13
by virtue of an office shall serve on the board while they hold that office. 14
(8) Appointed members of the council shall serve for a term of four (4) years. 15
Vacancies in the membership of the council shall be filled in the same manner as 16
the original appointments. If a nominating organization changes its name, its 17
successor organization having the same responsibilities and purposes shall be the 18
nominating organization. 19
(9) The council shall have no funds of its own, and council members shall not receive 20
compensation of any kind from the council. 21
(10) A majority of the members shall constitute a quorum for the transaction of business. 22
Members' designees shall have voting privileges at council meetings. 23
