AN ACT relating to protection from extreme weather conditions. 1
Be it enacted by the General Assembly of the Commonwealth of Kentucky: 2
SECTION 1. A NEW SECTION OF KRS CHAPTER 278 IS CREATED TO 3
READ AS FOLLOWS: 4
(1) As used in this section: 5
(a) "Extreme weather conditions" means a: 6
1. Day for which the National Weather Service has issued either an 7
Extreme Cold Warning or Extreme H eat Warning for the county in 8
which the customer resides; or 9
2. Period of natural disaster in the county in which the customer resides. 10
As used in this subparagraph, "natural disaster" means any natural 11
disaster resulting in the declaration of a state of emergency under 12
KRS 39A.100 or 39B.070; and 13
(b) "Utility" has the same meaning as in KRS 278.010(3)(a) and (b). 14
(2) Each utility shall submit an extreme weather disconnection plan to the 15
commission. The extreme weather disconnection plan shall identify how the 16
utility will prevent disconnection or suspension of resident ial service for 17
nonpayment to the customer during extreme weather conditions. 18
(3) The commission shall: 19
(a) Make available each utility's extreme weather disconnection plan on the 20
commission's website; and 21
(b) Order each utility with an extreme weather di sconnection plan to make its 22
extreme weather disconnection plan available on its utility website. 23
