A CONCURRENT RESOLUTION urging Kentucky's congressional delegation to 1
support amending the Gun Control Act of 1968 to allow users of medical cannabis to 2
exercise their Second Amendment right to bear arms. 3
WHEREAS, the Gun Control Act of 1968 currently prohibits the possession of 4
firearms by anyone who is an unlawful user of a controlled substance; and 5
WHEREAS, cannabis is listed as a controlled substance under the Controlled 6
Substances Act, and there are no exceptions in federal law for cannabis used for 7
medicinal purposes; and 8
WHEREAS, medical cannabis is used to treat conditions like chronic pain and 9
chemotherapy-induced nausea and vomiting; and 10
WHEREAS, the major ity of states have enacted laws permitting the legal use of 11
cannabis for medicinal purposes; and 12
WHEREAS, the General Assembly passed Senate Bill 47 during the 2023 Regular 13
Session, which established a medical cannabis program in the Commonwealth that came 14
into effect January 1, 2025; and 15
WHEREAS, the conflict between federal firearms restrictions and medical cannabis 16
laws has created confusion, inconsistency, and unnecessary legal risks for individuals 17
who seek to exercise their constitutional right to bear arms; and 18
WHEREAS, citizens of the Commonwealth should not be forced to choose between 19
accessing essential medical care and exercising their rights under the Second 20
Amendment; 21
NOW, THEREFORE, 22
Be it resolved by the Senate of the General Assembly of the Commonwealth of 23
Kentucky, the House of Representatives concurring therein: 24
Section 1. The Kentucky General Assembly respectfully urges Kentucky's 25
congressional delegation to support amending the Gun Control Act of 1968 to allow users 26
of medical cannabis to purchase and possess firearms. 27

Section 2. The Clerk of the Senate is directed to transmit a copy of this 1
Resolution to the Clerk of the United States House of Representatives, the Clerk of the 2
United States Senate, and each member of the Kentucky congressional delegation. 3
