A CONCURRENT RESOLUTION directing the Legislative Research Commission 1
to establish the Performance-Based Education Task Force. 2
WHEREAS, an education system grounded in time-based requirements rather than 3
learning acquisition is at odds with our educational aspirations; and 4
WHEREAS, the skills and knowledge to meet the needs of the modern economy 5
demand more than seat time as a primary indicator of learning outcomes; and 6
WHEREAS, the federal Every Student Succeeds Act of 2015, Pub. L. No. 114 -95, 7
defers to states to set the requirements and credit -earning activities for high school 8
graduation; and 9
WHEREAS, current administrative regulations in Kentucky permit local boa rds of 10
education to issue performance -based credit aligned with the Kentucky academic 11
standards, regardless of the number of instructional hours; and 12
WHEREAS, despite this option being available, adoption of performance -based 13
credit has yet to receive widespread adoption; and 14
WHEREAS, other states, such as Wyoming with its Reimaging and Innovating the 15
Delivery of Education Initiative (RIDE), have seen great success with initiatives to 16
expand performance-based credit earning opportunities among their students; and 17
WHEREAS, expansion of performance -based credit earning opportunities could 18
provide opportunities for academic success among students who may struggle in 19
achieving the traditional Carnegie time-based unit; and 20
WHEREAS, expansion of performance -based credit earning opportunities could 21
permit for an accelerated timeline in students earning a high school diploma and entering 22
into postsecondary education or the workforce, resulting in substantial economic 23
advantage to Kentucky; 24
NOW, THEREFORE, 25
Be it resolved by the Senate of the General Assembly of the Commonwealth of 26
Kentucky, the House of Representatives concurring therein: 27

Section 1. The Legislative Research Commission is hereby directed to establish 1
the Performance-Based Education Task Force to: 2
(1) Review statutes and administrative regulations that may permit or serve as a 3
barrier to performance-based credit earning opportunities; 4
(2) Review existing performance -based credit earning opportunities across 5
Kentucky to understand their impact and areas for improvement; and 6
(3) Assess support systems needed by local boards of education to encourage the 7
expansion of performance-based credit earning opportunities. 8
Section 2. The Performance -Based Education Task Force shall be composed of 9
the following 13 members, with final membership of the task force being subject to the 10
consideration and approval of the Legislative Research Commission: 11
(1) Three members of the House of Representatives to be appointed by the 12
Speaker of the House of Representatives, one of whom shall be designated to serve as co-13
chair; 14
(2) Three members of the Senate to be appointed by the President of the Senate, 15
one of whom shall be designated to serve as co-chair; 16
(3) One member of the House of Representatives to be appointed by the Minority 17
Floor Leader of the House of Representatives; 18
(4) One member of the Senate to be appointed by the Minority Floor Leader of 19
the Senate; 20
(5) The commissioner of education or designee; and 21
(6) To be appointed by the Legislative Research Commission: 22
(a) Two members with experience or expertise in developing or administering 23
performance-based credit earning opportunities in secondary education; and 24
(b) Two members who each serve as a member of a local board of education or as 25
a superintendent of a local school district in Kentucky. 26
Section 3. The Performance -Based Edu cation Task Force shall meet as 27

necessary during the 2026 Interim of the General Assembly. The task force shall develop 1
and submit any recommendations for changes the task force may adopt relating to the 2
expansion of performance -based credit earning opport unities across Kentucky's public 3
schools to the Legislative Research Commission for referral to the appropriate committee 4
or committees by December 1, 2026. 5
Section 4. Provisions of this Resolution to the contrary notwit hstanding, the 6
Legislative Research Commission shall have the authority to alternatively assign the 7
issues identified herein to an interim joint committee or subcommittee thereof, and to 8
designate a study completion date. 9
