A JOINT RESOLUTION applying for an Article V convention to propose an 1
amendment to the Constitution of the United States to set a limit on the number of terms 2
of office for members of Congress. 3
WHEREAS, in U.S. Term Limits, Inc. v. Thornton , 514 U.S. 779 (1995), the 4
Supreme Court of the United States declared that states could not individually impose 5
term limits on their own federal delegations through state statu tes, but could collectively 6
pass a term limits amendment to the Constitution of the United States; and 7
WHEREAS, Article V of the Constitution of the United States empowers states to 8
propose amendments to the Constitution of the United States on the applica tion of the 9
legislatures of two-thirds of the several states; and 10
WHEREAS, without term limits, members of Congress have an advantage in 11
elections that virtually guarantees a lifetime of reelections; and 12
WHEREAS, term limits for members of Congress will al low an equal balance of 13
power to all states, with leadership positions based on merit instead of political favors 14
and tenure of members; 15
NOW, THEREFORE, 16
Be it resolved by the General Assembly of the Commonwealth of Kentucky: 17
Section 1. The General Assembly of the Commonwealth of Kentucky hereby 18
applies to Congress, under the provisions of Article V of the Constitution of the United 19
States, for the calling of a convention for proposing amendments limi ted to proposing an 20
amendment to the Constitution of the United States to set a limit on the number of terms 21
that a member may be elected to the United States House of Representatives and to the 22
United States Senate. 23
Section 2. The Secretary of State of the Commonwealth of Kentucky is hereby 24
directed to transmit copies of this Joint Resolution to the President and Secretary of the 25
United States Senate, the Speaker, Clerk, and Judiciary Commit tee chair of the United 26
States House of Representatives, members of the United States Senate and United States 27

House of Representatives representing the Commonwealth of Kentucky, and the 1
presiding officers of each legislative house of the several states, r equesting their 2
cooperation. 3
Section 3. This Joint Resolution shall be considered an application covering the 4
same subject matter as the applications from other states to Congress to call a convention 5
to set a limit on t he number of terms that a member may be elected to the United States 6
House of Representatives and to the United States Senate, and this application shall be 7
aggregated with the same for the purpose of attaining the two-thirds of states necessary to 8
require Congress to call a limited convention on this subject, but it shall not be 9
aggregated with any other application on any other subject. 10
Section 4. This Joint Resolution constitutes a continuing application in 11
accordance with Article V of the Constitution of the United States until the legislatures of 12
at least two-thirds of the several states have made an application on the same subject. 13
