2 To amend and reenact R.S. 14:61(B)(introductory paragraph) and (1)(a)(v) and R.S.
3 51:3052(introductory paragraph) and (2) and to enact R.S. 14:61(B)(1)(a)(viii)
4 through (x), relative to critical infrastructure; to provide relative to the definition of
5 critical infrastructure; to provide for effectiveness; and to provide for related matters.
6 Be it enacted by the Legislature of Louisiana:
7 Section 1. R.S. 14:61(B)(introductory paragraph) and (1)(a)(v) are hereby amended
8 and reenacted and R.S. 14:61(B)(1)(a)(viii) through (x) are hereby enacted to read as
9 follows:
10 §61. Unauthorized entry of a critical infrastructure

12 B. For the purposes of this Section, the following words shall have the
13 following meanings:
14 (1)(a) "Critical infrastructure" means any and all structures, sites, equipment,
15 or other immovable or movable property located within or upon any of the
16 following:

18 (v) Transportation facilities, such as ports, railroad switching yards,
19 pipelines, and trucking terminals, airports, heliports, spaceports, aerospace facilities,
20 landing strips, mass transit and passenger rail terminals, postal facilities, and freight
21 transportation facilities.

6 Section 2. R.S. 51:3052(introductory paragraph) and (2) are hereby amended and
7 reenacted to read as follows:
8 §3052. Definitions
9 As used in this Chapter, the following terms have the following meanings
10 ascribed unless the context clearly indicates otherwise:

12 (2) "Critical infrastructure" means a any of the following:
13 (a) A communication infrastructure system,.
14 (b) A cybersecurity system,.
15 (c) An electric grid,.
16 (d) A hazardous waste treatment system, or.
17 (e) A water treatment facility.
18 (f) Transportation facilities, such as ports, railroad switching yards,
19 pipelines, trucking terminals, airports, heliports, spaceports, aerospace facilities,
20 landing strips, mass transit and passenger rail terminals, postal facilities, and freight
21 transportation facilities.
22 (g) Water control structures, including floodgates or pump stations.
23 (h) Wireline, wireless communications, and data network internet facilities,
24 and any equipment or communication wires that are connected or appurtenant to the
25 facilities, including but not limited to broadcast television equipment, video
26 equipment, fiber optics, and any lines or wires that are used for transmission from
27 the facilities.
28 (i) Government facilities.

4 Section 3. This Act shall become effective upon signature by the governor or, if not
5 signed by the governor, upon expiration of the time for bills to become law without signature
6 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If
7 vetoed by the governor and subsequently approved by the legislature, this Act shall become
8 effective on the day following such approval.
