distillers
1 AN ACT
2 To enact R.S. 26:2(38) and (39) and 82.2, relative to the transfer and sale of certain alcoholic
3 beverages; to provide for definitions; to provide for self-distribution; to provide for
4 limitations; to provide for effectiveness; and to provide for related matters.
5 Be it enacted by the Legislature of Louisiana:
6 Section 1. R.S. 26:2(38) and (39) and 82.2 are hereby enacted to read as follows:
7 §2. Definitions
8 For purposes of this Chapter, the following terms have the respective
9 meanings ascribed to them in this Section, unless a different meaning clearly appears
10 from the context:

12 (38) "Distilling facility" means the licensed premises of a manufacturing
13 distillery where liquor is manufactured for the primary purpose of selling the
14 finished product for resale and that is authorized to sell or serve to the public liquor
15 manufactured at the facility for consumption on or off the licensed premises of a
16 manufacturer as defined in this Section.
17 (39) "Premises", "licensed premises" or "premises to be licensed" means the
18 building or that part of the building as defined in the application for the permit in
19 which alcoholic beverages having an alcoholic content of more than six percent by
20 volume are sold. Except when such beverages are regularly sold or served outside
21 the building, the terms also include the outside area of the building.

1 §82.2. Transfer
2 Notwithstanding any provision of law to the contrary, a distilling facility that
3 distills liquor at a distillery located entirely within this state and that holds an in-state
4 high alcohol manufacturer's permit may use a wholesaler, for a set fee, to transfer
5 liquor distilled at the distilling facility to another manufacturing distillery in this state
6 owned wholly by the distilling facility to sell or serve to the public for consumption
7 on or off the licensed premises if all of the following conditions are met:
8 (1) The transferring distilling facility maintains no less than a five hundred
9 liter still, and the receiving distillery owned wholly by the transferring distilling
10 facility maintains no less than a one hundred liter still.
11 (2) The quantity of distilled liquor transferred is no greater than ten percent
12 of the total amount of liquor distilled monthly at the transferring distilling facility or
13 five hundred gallons.
14 (3) The quantity of distilled liquor transferred does not exceed an amount
15 greater than fifty percent of the receiving manufacturing distillery's production of
16 distilled liquor for the previous month.
17 (4) The receiving manufacturing distillery shall remit all state and parish or
18 municipal sales and excise taxes to the proper tax collecting authority for all products
19 received and sold to the public.
20 Section 2. The Louisiana State Law Institute is hereby authorized and directed to
21 arrange in alphabetical order and renumber the definitions provided in R.S. 26:2.
22 Section 3. This Act shall become effective upon signature by the governor or, if not
23 signed by the governor, upon expiration of the time for bills to become law without signature
24 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If
25 vetoed by the governor and subsequently approved by the legislature, this Act shall become
26 effective on the day following such approval.

Abstract: Provides relative to shipping to consumers from local distillers.
Proposed law defines "distilling facility" as a licensed premises of a manufacturing distillery
where liquor is manufactured for the primary purpose of selling and that is authorized to sell
the finished product.
Proposed law defines "premises" as the building or that part of the building where beverages
having an alcoholic content of more than 6% by volume are sold. Includes the outside area
of a building if alcoholic beverages are regularly sold outside of the building.
Proposed law authorizes an in-state distilling facility located in the state of La. to transfer
liquor through a wholesaler, for a set fee, to another in-state manufacturing distillery that is
also owned by the distilling facility under the following conditions:
(1) The transferring facility maintains no less than a 500 liter still and the receiving
distillery maintains no less than a 100 liter still.
(2) The amount of distilled liquor transferred is no greater than 10% of the total amount
of liquor distilled monthly at the transferring facility or 500 gallons.
(3) The quantity of liquor transferred does not exceed an amount greater than 50% of the
transferring facility's production of liquor for the previous month.
(4) All state and parish or municipal sales and excise taxes are paid to the proper tax
collecting authority.
Effective upon signature of governor or lapse of time for gubernatorial action.

Summary of Amendments Adopted by House
The Committee Amendments Proposed by House Committee on Judiciary to the original
bill:
1. Authorize a manufacturing distilling facility located in the state of La. to transfer
