1 AN ACT
2 To amend and reenact R.S. 47:9008(A)(8) and to enact R.S. 14:90(F) and 90.3(L) and R.S.
3 47:9001(C), 9002(31), 9008(B) and (D), and 9054(A)(9), relative to the lottery; to
4 provide relative to the ordering of lottery tickets; to provide for the ordering of
5 lottery tickets through authorized lottery courier services over the internet; to provide
6 for the oversight by the Louisiana Lottery Corporation of licensed lottery retailers
7 who contract with courier services; and to provide for related matters.
8 Be it enacted by the Legislature of Louisiana:
9 Section 1. R.S. 14:90(F) and 90.3(L) are hereby enacted to read as follows:
10 §90. Gambling

12 F. The authorization and operation of a lottery courier service, as provided
13 in R.S. 47:9008, shall not be considered gambling for the purposes of this Section.

17 L. Ordering lottery tickets through a lottery courier service via the Internet,
18 as provided in R.S. 47:9008, shall not be considered gambling by computer for the
19 purposes of this Section. Fulfillment of lottery courier service orders via the
20 Internet, as provided in R.S. 47:9008, shall also not be considered gambling by
21 computer for the purposes of this Section.

1 Section 2. R.S. 47:9008(A)(8) is hereby amended and reenacted and R.S.
2 47:9001(C), 9002(31), 9008(B) and (D), and 9054(A)(9) are hereby enacted to read as
3 follows:
4 §9001. Statement of purpose and intent

6 C. The legislature finds that operating a lottery in a manner that maximizes
7 revenue from lottery games, while operating with integrity and dignity, serves the
8 best interests of the state.
9 §9002. Definitions
10 * * *
11 (31) "Courier service" means a person or organization that purchases and
12 stores a lottery ticket on behalf of a customer located in this state and delivers the
13 lottery ticket, or the prize from the lottery ticket, to the customer in this state as a for-
14 profit service.

16 §9008. Board; lottery games; regulation
17 A. The board may adopt rules for the conduct of specific lottery games and
18 operations, including but not limited to rules specifying:

20 (8) The manner and amount of compensation to lottery retailers, except all
21 compensation shall be uniform.
22 (a) The board shall establish a base retailer commission for retail sales at five
23 percent of gross sales.
24 (b) The board shall review and adjust the base retailer commission amount
25 to apply for the twelve-month period commencing on July first, or on another date
26 within the year in which the adjustment is made. In the review, the base retailer
27 commission shall be revised upward at least one-quarter percent for each eight
28 million dollar increase in gross sales over the prior fiscal year. Base retailer

1 commissions shall not be lowered pursuant to this Subparagraph and shall not exceed
2 a maximum of seven percent for base commission for retail sales.
3 (c) Sales by licensed retailers to lottery couriers to fulfill customer orders in
4 this state shall be subject to a base retailer commission of one percent lower than the
5 base commission awarded for general lottery ticket sales. That remaining one
6 percent shall be reserved for the benefit of retailers who do not participate in courier
7 sales, and allocated in accordance with this Section.
8 (i) No less than once every three months, the board shall evaluate the
9 proportionate sales of retail lottery sales that exclude fulfillment of lottery courier
10 orders.
11 (ii) The board shall calculate each licensed retailer's proportionate share of
12 lottery retail sales that exclude fulfillment of lottery courier orders.
13 (iii) The board shall divide the one percent retained base retailer commission
14 for lottery courier sales on a pro rata basis and distribute the funds representing the
15 retained one percent commission among licensed retailers that do not participate in
16 fulfillment of lottery courier orders.
17 (d) The board shall further adopt rules in accordance with the Administrative
18 Procedure Act that allow for additional selling bonuses, cash incentives, and
19 promotional incentives for retailers as may be necessary to ensure a robust and
20 effective retailer base for lottery sales within the state.

22 B. The board shall adopt rules in accordance with the Administrative
23 Procedure Act to regulate licensed lottery retailers that sell tickets to a courier
24 service to fulfill an order for lottery tickets placed by a courier service customer in
25 this state. The rules shall authorize a courier service to fulfill orders for lottery
26 tickets placed by adult customers located within this state pursuant to the terms set
27 forth in this Section. The rules adopted pursuant to this provision shall include but
28 not be limited to the following:

1 (1) A licensed retailer that seeks to sell lottery tickets to a courier service in
2 this state shall do so through a written agreement between the courier service and the
3 licensed retailer.
4 (2) The licensed retailer shall disclose the existence and substance of a
5 written agreement between the licensed retailer and the courier service within five
6 business days of the execution of such agreement.
7 (3) A written agreement between a licensed retailer and a courier service to
8 fulfill courier service orders for the sale of lottery tickets shall contain the following
9 terms:
10 (a) A requirement that a courier service may only accept orders from a
11 customer for draw and scratch games that are also available for sale at licensed retail
12 locations.
13 (b) A requirement that a courier service deliver scanned images of lottery
14 tickets ordered through the courier service to ordering customers.
15 (c) A requirement that a courier service only accept a lottery ticket order
16 from a customer who has been determined to be physically located within this state
17 and not on federally recognized tribal grounds at the time of the customer order.
18 (d) A requirement that a courier service employ effective age verification
19 software that allows a customer who is of lawful age to purchase a lottery ticket
20 pursuant to R.S. 47:9070 to order a lottery ticket through the courier service.
21 (e) A requirement that a courier service securely store a lottery ticket
22 purchased on behalf of a customer until the prize for the ticket is redeemed at retail
23 by the courier service, or until the lottery ticket retrieved by or delivered to the
24 customer for the customer to redeem the prize through the corporation.
25 (f) A requirement that a courier service maintain appropriate controls for
26 responsible play, including the use of daily, weekly, or monthly limits that may be
27 reduced by the customer, as well as self-exclusion capabilities. The agreement shall
28 also require advertisements and communications from the courier service to comply
29 with applicable responsible gaming advertising guidelines.

1 (g) A requirement that a courier service only purchase tickets from the
2 licensed retailer at dedicated terminals which shall be provided by the corporation
3 to the licensed retail location.
4 (h) A requirement that the courier service only pay for lottery tickets
5 purchased from the licensed retailer using methods of purchase authorized by the
6 corporation for the purchase of lottery tickets at retail, including but not limited to
7 cash or automated clearing house transfers.
8 (i) A provision allowing a courier service to assess a fee to a customer for
9 the cost of order fulfillment and storage. Notwithstanding R.S. 47:9057 or any
10 contrary rule or provision, any courier service or convenience fee that is disclosed
11 to the customer in advance of an order is permissible and is not to be construed as
12 adding to the price of the lottery ticket.
13 (j) A requirement that the courier service annually obtain a report from a
14 firm nationally recognized for providing audit, testing, or certification services that
15 certify that the courier is in compliance with the written agreement between the
16 courier service and the retailer, which the courier service shall provide to the retailer
17 upon request.
18 (4) In adopting rules and regulating the conduct of retailers who contract
19 with lottery couriers to fulfill customer lottery ticket orders within this state, the
20 board shall direct the corporation to use existing rules and procedures to the greatest
21 extent possible to authorize lottery couriers and implement lottery courier services
22 pursuant to this Section without undue delay.

24 D. Consistent with the goal to maximize revenues for the state, the board
25 shall direct the corporation to review and update its processes relating to the
26 approval, sale, adoption, and marketing of lottery scratch tickets at denominations
27 above twenty dollars. The corporation shall provide the board with a report that
28 creates actionable timeframes for expanding scratch ticket availability and increasing
29 scratch ticket denominations available for sale by licensed retailers within the state.

1 §9054. Content of retailer contracts; contract cancellation by president
2 A. Any contract executed by the corporation pursuant to this Subtitle shall
3 specify the reasons for which any contract may be cancelled, suspended, revoked,
4 or terminated by the corporation, which reasons shall include but not be limited to:

6 (9) Failure by a retailer to comply with the rules and regulations adopted by
7 the corporation relating to sales of tickets to lottery couriers.

9 Section 3. Beginning March 1, 2027, and annually thereafter, the board shall review
10 and adjust the base retailer commission as required by R.S. 47:9008(A)(8)(b), as enacted by
11 Section 1 of this Act.
12 Section 4. Within ninety days of the effective date of R.S. 47:9008(D), and annually
13 thereafter, the corporation shall provide the board with the report described in R.S.
14 47:9008(D), as enacted by Section 1 of this Act.
15 Section 5. The Louisiana State Law Institute is hereby authorized and directed to
16 renumber the new entry of R.S. 47:9002(31), as enacted by Section 1 of this Act, to ensure
17 that definitions are listed in alphabetical order.

Proposed law provides that the authorization, operation, ordering, and fulfillment of lottery
tickets through a lottery courier service over the internet is not gambling or gambling by
computer.
Proposed law defines "courier service".
Present law authorizes the board of directors of the La. Lottery Corporation (the board) to
adopt rules in accordance with the APA for the conduct of specific lottery games and
operations.

Proposed law requires the board to establish base retailer commissions for retail sales at 5%
of gross sales, and requires the board to review and adjust the base commission annually.
Proposed law requires the board to allocate 1% of the base commission for the benefit of
retailers who do not participate in courier sales.
Proposed law requires the board to adopt certain rules in accordance with the APA to
regulate lottery couriers, including requiring a written agreement between the courier and
retailer and disclosure of the written agreement.
Proposed law requires the following to be included in the agreement between the courier and
retailer:
(1) That the courier only accept orders for tickets that are available at retail locations.
(2) That the courier deliver scanned images of tickets to ordering customers.
(3) That the courier only accept orders from customers physically located in the state of
La.
(4) That the courier use age verification software.
(5) That the courier securely store purchased tickets for the customer until the ticket is
redeemed or retrieved by the customer.
(6) That the courier maintain controls to mitigate compulsive gaming.
(7) That the courier only purchase tickets at a dedicated terminal.
(8) That the courier use methods of payment that are available at retail locations.
(9) That the courier may charge a service fee to the customer if the fee is distinct from
the price of the ticket.
(10) That the courier annually obtain an audit report from a nationally recognized firm
and provide the report to the retailer upon request.
Proposed law requires the board to regularly review and update its processes related to
certain lottery tickets.
Proposed law provides that failure by a retailer to comply with rules and regulations may
result in termination of the agreement.

9002(31), 9008(B) and (D), and 9054(A)(9))
