1 AN ACT
2 To enact R.S. 17:3384, relative to tuition and mandatory fee amounts for public
3 postsecondary education institutions; to authorize each public postsecondary
4 education institution to impose and adjust certain tuition and fee amounts; to provide
5 for limitations; to provide for applicability; to provide for an effective date; to
6 provide for reporting; and to provide for related matters.
7 Be it enacted by the Legislature of Louisiana:
8 Section 1. R.S. 17:3384 is hereby enacted to read as follows:
9 §3384. Public postsecondary education institutions; tuition and fee authority
10 and autonomy
11 A.(1) Notwithstanding any other provision of law to the contrary, each public
12 postsecondary education institution may establish and adjust tuition and fee amounts
13 for all programs offered by the institution, including programs granting certificates,
14 degrees, diplomas, or other credentials of value. This authority includes establishing
15 tuition and fee amounts for part-time students, dual enrollment students, and students
16 enrolled in summer and intersession terms.
17 (2) Each institution may increase tuition and mandatory fee amounts by no
18 more than fifteen percent over any one-year period. Each institution may lower
19 tuition and fee amounts with no limitation.

1 (3) The authority to establish and adjust tuition and fee amounts as provided
2 in this Section shall be applicable beginning on January 1, 2027.
3 B. When establishing tuition and fee amounts, each public postsecondary
4 education institution shall, at a minimum, consider the following:
5 (1) Tuition and fee amounts of peer institutions.
6 (2) Median household income in Louisiana and in states where peer
7 institutions are located.
8 (3) Affordability.
9 (4) Total cost of attendance.
10 C. Each public postsecondary education institution shall establish a process
11 for providing adequate notice to students of tuition and fee amounts. Prior to
12 imposing any increase in tuition and fee amounts pursuant to this Section, each
13 institution shall establish criteria for waivers in cases of financial hardship. Such
14 information shall be made available to all current and prospective students affected
15 by the increase in a timely manner.
16 D. Each public postsecondary education institution shall submit a written
17 report to its management board, the Board of Regents, the House Committee on
18 Education, the Senate Committee on Education, the House Committee on
19 Appropriations, and the Senate Committee on Finance not later than February fifteenth
20 annually regarding how the tuition and mandatory fees authorized by this Section are being
21 implemented.
22 Section 2. This Act shall become effective upon signature by the governor or, if not
23 signed by the governor, upon expiration of the time for bills to become law without signature
24 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If
25 vetoed by the governor and subsequently approved by the legislature, this Act shall become
26 effective on the day following such approval.

Present law provides that each public postsecondary education management board may
exercise powers necessary to supervise and manage the day-to-day operations of institutions
under its control, including the authority to:
(1) Determine the tuition and mandatory fees which shall be paid by students and adjust
the amount of tuition and fees.
(2) Establish mandatory fee amounts for all programs at each institution under its
supervision and control and consolidate separate fees.
(3) Relative to differential tuition and mandatory fee amounts:
(a) Establish differential tuition for any graduate, professional, or specialized
program.
(b) Establish differential tuition for any undergraduate program, including but
not limited to programs granting certificates, degrees, diplomas, or other
credentials of value, that has been identified as a high-cost program by the
Bd. of Regents.
(c) Increase differential tuition amounts and mandatory fee amounts by no more
than 10% over any two-year period and lower tuition and fee amounts with
no limitation.
Proposed law retains present law and provides the following:
(1) Authorizes each public postsecondary education institution to establish and adjust
tuition and fee amounts for all programs offered by the institution, including
programs granting certificates, degrees, diplomas, or other credentials of value.
(2) Provides that each institution may increase tuition and mandatory fee amounts by
no more than 15% over any one-year period and allows each institution to lower
tuition and fee amounts with no limitation.
(3) Provide that the authority to establish and adjust tuition and fee amounts as provided
proposed law shall be applicable beginning on Jan. 1, 2027.
Present law requires each management board to establish a process for providing adequate
