CORRECTIONS/PRISONERS: Authorizes the city of Zachary to use certain inmates to cut
grass in certain cemeteries
1 AN ACT
2 To enact R.S. 8:415.1, relative to authorizing the city of Zachary to use certain inmates to
3 cut grass in public cemeteries; to provide for the maintenance of certain cemeteries;
4 to allow for the use of inmate labor; to provide relative to the use of funds; and to
5 provide for related matters.
6 Notice of intention to introduce this Act has been published
7 as provided by Article III, Section 13 of the Constitution of
8 Louisiana.
9 Be it enacted by the Legislature of Louisiana:
10 Section 1. R.S. 8:415.1 is hereby enacted to read as follows:
11 §415.1. City of Zachary; use of labor by prisoners
12 A. For the purpose of abating any public health or safety risks, the city of
13 Zachary may, after consultation with the division, use prison labor to clean and
14 maintain abandoned cemeteries.
15 B. The use of labor by a prisoner sentenced to a parish prison of any parish
16 of the state, by any court of competent jurisdiction, or a prisoner in a parish prison
17 awaiting transfer to a state correctional facility, to clean and maintain abandoned
18 cemeteries for the city of Zachary, shall be subject to the provisions of R.S. 15:708.

1 C. Notwithstanding any other provisions of law to the contrary, the city of
2 Zachary may use funds appropriated by the legislature to maintain a cemetery to pay
3 for prison labor from Dixon Correctional Institute.

Proposed law provides that the use of labor by a prisoner sentenced to a parish prison of any
parish of the state, by any court of competent jurisdiction, or a prisoner in a parish prison
awaiting transfer to a state correctional facility, to clean and maintain abandoned cemeteries
for the city of Zachary, shall be subject to the provisions of present law.
