MOTOR VEHICLES: Provides relative to the location of a used motor vehicle dealer
1 AN ACT
2 To enact R.S. 32:791(K), relative to the location of a used motor vehicle dealer; to provide
3 relative to the location of a licensed facility; to provide relative to a dealer's
4 registered place of business; and to provide for related matters.
5 Be it enacted by the Legislature of Louisiana:
6 Section 1. R.S. 32:791(K) is hereby enacted to read as follows:
7 §791. Application for license; renewal; fees; educational seminar; bond
8 requirements; liability insurance; salesperson's license; location of business

10 K. A sale shall still be deemed to occur at the facility licensed by the
11 commission and it shall not be a violation of any provision of this Title for a used
12 motor vehicle dealer to do any of the following:
13 (1) Deliver a used motor vehicle to a customer for a test drive away from the
14 used motor vehicle dealer’s registered place of business.
15 (2) Deliver documents for signature of the parties away from the used motor
16 vehicle dealer’s registered place of business.
17 (3) Deliver documents to, or obtain documents from, a customer away from
18 the used motor vehicle dealer's registered place of business.
19 (4) Deliver a used motor vehicle to a customer away from the used motor
20 vehicle dealer’s registered place of business.

Abstract: Provides relative to the location of a used motor vehicle dealer.
Present law provides relative to the location of a used motor vehicle dealer.
Proposed law adds that a sale shall still be deemed to occur at a facility licensed by the
commission and it shall not be a violation of any provision of present law for a used motor
vehicle dealer to do any of the following:
(1) Deliver a used motor vehicle to a customer for a test drive away from the used motor
vehicle dealer's registered place of business.
(2) Deliver documents for signature of the parties away from the used motor vehicle
dealer's registered place of business.
(3) Deliver documents to, or obtain documents from, a customer away from the used
motor vehicle dealer's registered place of business.
(4) Deliver a used motor vehicle to a customer away from the used motor vehicle
dealer's registered place of business.
