1 AN ACT
2 To enact R.S. 40:1730.29(A)(20) and 1730.40(D), relative to the regulation of construction
3 or improvement of industrial facilities; to provide for exemptions for certain
4 industrial facilities; to provide for the regulation of certain industrial facilities; to
5 provide for effectiveness; and to provide for related matters.
6 Be it enacted by the Legislature of Louisiana:
7 Section 1. R.S. 40:1730.29(A)(20) and 1730.40(D) are hereby enacted to read as
8 follows:
9 §1730.29. Regulation of construction or improvement of industrial facilities
10 A. Excluding the applicable requirements of the International Plumbing
11 Code, the provisions of this Part shall not apply to the construction or improvement
12 inside the secured or fenced confines of the following types of industrial facilities
13 that are engaged in activities defined or classified under one or more of the following
14 subsectors, industry groups, or industries of the 2012 North American Industry
15 Classification System (NAICS):

22 D. Notwithstanding any other provision of law to the contrary, no political
23 subdivision shall require a building permit for, apply the provisions of a building
24 code to, or otherwise regulate pursuant to this Part the construction or improvement
25 inside the secured or fenced confines of the industrial facilities exempted in R.S.
26 40:1730.29(A)(20).

1 Section 2. This Act shall become effective upon signature by the governor or, if not
2 signed by the governor, upon expiration of the time for bills to become law without signature
3 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If
4 vetoed by the governor and subsequently approved by the legislature, this Act shall become
5 effective on the day following such approval.
