CIVIL/INTERDICTION: Provides with respect to interdicted persons
1 AN ACT
2 To amend and reenact Civil Code Article 2997(introductory paragraph) and (7), relative to
3 interdicted persons; to provide relative to duties and restrictions of curators,
4 undercurators, and mandataries; and to provide for related matters.
5 Be it enacted by the Legislature of Louisiana:
6 Section 1. Civil Code Article 2997(introductory paragraph) and (7) are hereby
7 amended and reenacted to read as follows:
8 Art. 2997. Express authority required
9 Authority shall also must be given expressly to:

11 (7) Prevent or limit reasonable communication, visitation, or interaction
12 between the principal and a relative by blood, adoption, or affinity within the third
13 degree, or another individual who has a relationship based on or productive of strong
14 affection.

Abstract: Provides relative to interactions, communications, and visitation with interdicted
persons.
Present law authorizes a mandatary to perform all acts which are incidental or necessary to
fulfill the obligations as mandatary.
Proposed law retains present law.
Present law provides that express authority must be given to limit or prevent reasonable
communication, visitation, or interaction between the principal and a relative by blood,
adoption, or affinity within the third degree, or another individual who has a relationship
based on or productive of strong affection.
Proposed law amends present law to specify that the relationship between the principal and
another individual is to be based only on strong affection. Otherwise retains present law.
