PROPERTY/PUBLIC: Provides relative to the selling of state-owned surplus movable
property
1 AN ACT
2 To amend and reenact R.S. 39:330.1(A)(1), relative to the sale of surplus state-owned
3 property; to provide for preference of in-state auctioneers; to provide for an effective
4 date; and to provide for related matters.
5 Be it enacted by the Legislature of Louisiana:
6 Section 1. R.S. 39:330.1(A)(1) is hereby amended and reenacted to read as follows:
7 §330.1. Sale of surplus property
8 A.(1) Notwithstanding any other provision of law to the contrary and except
9 as provided by R.S. 39:330(G), the commissioner of administration, on behalf of the
10 state, is hereby authorized to sell surplus movable property of any board,
11 commission, agency, or department of the state at public auction. In the case of live
12 public auction, the commissioner of administration may hire qualified licensed
13 auctioneers to handle said sale, who shall be compensated from the proceeds of such
14 sale.
15 (a) Selection of an auctioneer shall be by competitive bid under the
16 provisions of the Louisiana Procurement Code, R.S. 39:1551 et seq. The selection
17 of the auctioneer shall be for the period of one year and the commissioner shall be
18 required to select the auctioneer by competitive bid annually.

1 (b) Where both in-state and out-of-state auctioneers are bidding, in-state
2 auctioneers shall be given preference, provided such services are equal in quality and
3 do not exceed in cost by more than ten percent of services available from outside the
4 state.

6 Section 2. This Act shall become effective upon signature by the governor or, if not
7 signed by the governor, upon expiration of the time for bills to become law without signature
8 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If
9 vetoed by the governor and subsequently approved by the legislature, this Act shall become
10 effective on the day following such approval.
