TRAFFIC/VIOLATIONS: Provides relative to use of automated and electronic speed
enforcement devices for the issuance of citations
1 AN ACT
2 To amend and reenact R.S. 32:43(A)(4) and 46(C), relative to the authorization to use
3 automated and electronic speed enforcement devices in certain municipalities; to
4 provide an exception to the prohibition against the use of automated and electronic
5 speed enforcement devices for certain municipalities; and to provide for related
6 matters.
7 Be it enacted by the Legislature of Louisiana:
8 Section 1. R.S. 32:43(A)(4) and 46(C) are hereby amended and reenacted to read as
9 follows:
10 §43. Automated speed enforcement devices; prohibition

13 (4)(a) The provisions contained in this Section shall not apply to a governing
14 authority of a municipality with a population of less than sixteen thousand and more
15 than fifteen thousand according to the latest federal decennial census within a parish
16 with a population of less than ninety thousand and more than seventy thousand
17 according to the latest federal decennial census.
18 (b) The provisions contained in this Section shall not apply to a parish,
19 including its municipalities, with a population of not less than four hundred thirty-

1 nine thousand and not more than four hundred forty-two thousand according to the
2 latest federal decennial census.

4 §46. Electronic enforcement devices; school zone restrictions

6 C.(1) The provisions contained in this Section shall not apply to a governing
7 authority of a municipality with a population of less than sixteen thousand and more
8 than fifteen thousand according to the latest federal decennial census within a parish
9 with a population of less than ninety thousand and more than seventy thousand
10 according to the latest federal decennial census.
11 (2) The provisions contained in this Section shall not apply to a parish,
12 including its municipalities, with a population of not less than four hundred thirty-
13 nine thousand and not more than four hundred forty-two thousand according to the
14 latest federal decennial census.

Abstract: Exempts the certain municipalities from the prohibition against using automated
and electronic speed enforcement devices.
Present law (R.S. 32:43) requires that automated speed enforcement devices or mobile speed
cameras only be used in school zones posted in accordance with present law. Further
requires that present law not apply to a governing authority of a municipality with
populations less than 16,000 and more than 15,000 within a parish with a population of less
than 90,000 and more than 70,000 according to the latest federal decennial census.
Proposed law exempts parishes, including its municipalities, with a population of not less
than 439,000 and not more than 442,000 according to the latest federal decennial census.
Present law (R.S. 32:46) restricts the use of electronic enforcement devices in school zones
on school days during specified time periods, except for a governing authority of a
municipality with populations less than 16,000 and more than 15,000 within a parish with
a population of less than 90,000 and more than 70,000 according to the latest federal
decennial census.
