1 AN ACT
2 To amend and reenact R.S. 32:429.4(E) and (F)(1) and 863.1.2(B), relative to the terms of
3 installment agreements for outstanding fines, penalties, and fees owed to the office
4 of motor vehicles; to extend the issuance of certain late fees for failure to make
5 timely payments; to provide for requirements before a person is removed from the
6 Reinstatement Relief Program; and to provide for related matters.
7 Be it enacted by the Legislature of Louisiana:
8 Section 1. R.S. 32:429.4(E) and (F)(1) and 863.1.2(B) are hereby amended and
9 reenacted to read as follows:
10 §429.4. Installment agreement; outstanding penalties, fines, and fees owed to the
11 office of motor vehicles

13 E. The failure to make a scheduled payment in accordance with the terms of
14 the installment agreement shall result in the missed scheduled payment being added
15 to the end of the payment schedule of the installment agreement and shall apply to
16 the first three missed payments. Upon a fourth, or any subsequent, missed payment
17 an assessment of a late fee in the amount of twenty-five dollars, which shall be added
18 to the total amount due. Upon the failure to receive a payment, the office of motor
19 vehicles shall send an electronic mail notification to the debtor to update the debtor's
20 payment information and pay the missed payment. If, after receiving the electronic

1 mail notice, the debtor updates the payment information, pays the late fee, and
2 submits the missed payment, the The installment agreement shall remain in place and
3 no further action will shall be taken until the fourth, and any subsequent, missed
4 payment. In such case, the missed payment and late fee shall be received by the
5 office of motor vehicles prior to the next scheduled payment date.
6 F. Termination of installment agreement upon failure to make payment.
7 (1) If any installment payment is not paid on or before the date fixed for its
8 payment or rescheduled, and the debtor fails to make up the missed payment as
9 provided in Subsection E of this Section, the entire amount unpaid pursuant to the
10 installment agreement shall be paid by the debtor within a sixty-day period from the
11 date of notice and demand from the commissioner of the office of motor vehicles.
12 The notice shall further advise the debtor that his driver's license shall be suspended
13 upon the expiration of the sixty-day period if the payments due pursuant to the
14 installment agreement are not made current within that sixty-day period or the
15 agreement is not reinstated by the commissioner of the office of motor vehicles
16 within that sixty-day period. This notice shall be known as "Notice of Installment
17 Agreement Termination and Demand".

21 B. The commissioner shall determine the amount of reinstatement fees that
22 the person owes. The person shall promptly pay the amount determined to be owed
23 no later than ten calendar days from the date that the commissioner sets the amount
24 that is owed. If the person needs to make payment arrangements, the person shall
25 execute an installment agreement with the office of motor vehicles. Such an
26 installment agreement shall only be for the amount determined to be owed by the
27 commissioner together with all fees associated with the installment agreement as
28 provided in R.S. 32:429.4. If a person executes an installment contract, that person
29 shall maintain eligibility to remain in the Reinstatement Relief Program only if they

1 make all payments required in the installment agreement. If a person fails to make
2 a timely payment and fails to pay the missed payment with the associated late fee
3 before the next scheduled payment meet the requirements of the installment
4 agreement pursuant to R.S. 32:429.4, the person shall be removed from the
5 Reinstatement Relief Program and shall not be eligible to reenter the Reinstatement
6 Relief Program.

Abstract: Provides relative to the issuance of certain late fees for failure to make timely
payments and to removal of persons from the Reinstatement Relief Program.
Present law (R.S. 32:429.4(E)) authorizes the office of motor vehicles (OMV) to enter into
installment agreements with eligible persons for payment of outstanding fines, penalties, and
fees owed. Further specifies that failure to make a scheduled payment will result in the
assessment of a late fee of $25, added to the total amount due. Additionally requires the
OMV, upon the failure to receive a payment, to send an electronic mail notification to the
debtor to update the debtor's payment information and pay the missed payment. Further
requires that after receiving the electronic mail notice, the debtor updates the payment
information, pays the late fee, and submits the missed payment will result in the installment
agreement remaining in place and no further action will be taken. Specifies that in these
cases, the missed payment and late fee must be received by the OMV vehicles prior to the
next scheduled payment date.
Proposed law specifies that the first three missed payments will be added to the end of the
payment schedule of the installment agreement and any fourth, or subsequent, missed
payment will result in the late fee of $25 added to the total amount due. Requires the
installment agreement remain in place until a fourth, and any subsequent, missed payment
occurs.
Present law (R.S. 32:429.4(F)(1)) specifies that if a debtor missed an installment payment
and does not make it up as provided in present law the entire amount has to be paid within
60 days of the date of notice and demand from the commissioner of the OMV.
Proposed law modifies present law by providing that, if any installment payment is not paid
on or before the date fixed for its payment or rescheduled and the debtor fails to make up the
missed payment as provided for in proposed law, the entire amount unpaid pursuant to the
installment agreement shall be paid by the debtor within a 60-day period from the date of
notice and demand from the commissioner of the OMV.
Present law (R.S. 32:863.1.2) authorizes the commissioner of the OMV to implement a
Reinstatement Relief Program for a person and to determine the amount of reinstatement
fees that the person owes. Further requires that the person promptly pay the amount
determined to be owed no later than 10 days from the date that the commissioner sets the

amount owed through an installment agreement for the amount determined, together with
all fees associated with the agreement. Specifies that a person will only maintain eligibility
to remain in the Reinstatement Relief Program if they make all payments required in the
installment agreement. Further specifies that failure to make a timely payment and failure
to pay the missed payment with the associated late fee before the next scheduled payment,
the person will be removed the program and not be eligible to reenter.
Proposed law provides that a person enrolled in the Reinstatement Relief Program will be
removed from the program upon failure to meet the requirements of proposed law (R.S.
32:429.4), instead of the failure to make a timely payment and pay the associated late fee.
