HOUSE BILL NO. 1195

1 AN ACT
2 To amend and reenact R.S. 4:64, 65(C)(introductory paragraph), 82, 82.2, and 422(D), to
3 enact R.S. 4:82.3 and 422(E) and (F), and to repeal R.S. 4:422(C), relative to the
4 Louisiana State Athletic Commission; to provide for rules and regulations of
5 contests or exhibitions; to provide for fines and penalties; to provide for penalties for
6 noncompliance; to provide for disciplinary actions by the commission; to provide a
7 fee schedule for the registration of athlete agents; to provide for the deposit of
8 monies collected from fees into the Department of Justice Legal Support Fund; to
9 provide relative to the term of registration; and to provide for related matters.
10 Be it enacted by the Legislature of Louisiana:
11 Section 1. R.S. 4:64, 65(C)(introductory paragraph), 82, 82.2, and 422(D) are hereby
12 amended and reenacted and R.S. 4:82.3 and 422(E) and (F) are hereby enacted to read as
13 follows:
14 §64. Rules and regulations
15 The commission may make rules and regulations governing all boxing,
16 mixed technique events, and wrestling contests or exhibitions under its jurisdiction,
17 the sale of tickets at such those contests or exhibitions, the promoters of such those
18 contests or exhibitions, and the contestants, their seconds and managers in such those
19 contests or exhibitions, and all other rules and regulations as the commission, in its
20 discretion, deems necessary to carry out the purposes of this Chapter. Should any
21 case occur which may not be covered in this Chapter or by the rules and regulations
22 of the commission, it shall be determined by the commission, but only insofar as
23 such determination is consistent with justice, the best interests of boxing, mixed

1 technique event, and wrestling and with the powers and authority granted by this
2 Chapter. A copy of the pertinent rules and regulations of the commission shall be
3 furnished to the contestants or their managers in contests or exhibitions subject to the
4 jurisdiction of the commission. No such contest or exhibition shall be conducted,
5 held, or given except in accordance with the provisions of this Chapter and the rules
6 and regulations of the commission, including but not limited to any official rules for
7 sports not specifically mentioned in this Chapter that require commission approval
8 or sanctioning, provided that no such boxing contest or exhibition shall exceed
9 twenty twelve rounds.
10 §65. Licenses; fees; bond

12 C. The commission may for cause, and after a hearing, revoke or suspend
13 any license issued under in accordance with the provisions of this Chapter, or may
14 fine the holder of such license the sum of not more than one five thousand dollars,
15 or both, for any of the following reasons:

17 §82. Noncompliance with Chapter; penalty
18 Whoever conducts, promotes, or in any manner participates in any boxing,
19 mixed technique event, or wrestling contest or exhibition without first complying
20 with the provisions of this Chapter shall be fined not more than five hundred
21 thousand dollars.

23 §82.2. Noncompliance with Chapter; injunction
24 A. In addition to the actions and penalties otherwise provided for by this
25 Chapter, the commission may cause to issue in any court of competent jurisdiction
26 an injunction without bond enjoining any person from violating or continuing to
27 violate the provisions of this Chapter. In addition to or in lieu of the criminal
28 penalties or administrative remedies or sanctions provided in this Chapter or
29 administrative rules, the commission may issue an order to any licensee or other
30 person or entity engaged in any activity, conduct, or practice in violation of this

1 Chapter or those rules, directing that person or entity to immediately cease and desist
2 from that activity, conduct, or practice. This order shall be issued in the name of the
3 state, under the official seal of the commission.
4 B. In the suit for an injunction, the commission may demand of the
5 defendant reasonable attorney fees and court costs. If the person or entity to whom
6 the commission directs a cease and desist order does not cease and desist the
7 prohibited activity, conduct, or practice within three business days of receipt of that
8 order, the commission, through its proper officer or agent, may seek and cause to
9 issue in any court of competent jurisdiction and venue a writ of injunction, including
10 a temporary restraining order, enjoining that person or entity from engaging in the
11 prohibited activity, conduct, or practice.
12 C. The judgment for attorney fees and court costs may be rendered in the
13 same judgment in which the injunction is made absolute. If the commission brings
14 an action against an individual pursuant hereto and fails to prove its case, then it
15 shall be liable to such person for the payment of his attorney fees and costs. In a suit
16 for an injunction, the commission may demand of the defendant reasonable attorney
17 fees, associated investigative and administrative expenses, and costs of court. The
18 judgment for attorney fees, expenses, and costs may be rendered in the same
19 judgment in which the injunction is made absolute.
20 D.(1) Upon a proper showing by the commission that a person or entity has
21 engaged in any activity, conduct, or practice prohibited by this Chapter or
22 commission rule, the court shall issue a temporary restraining order enjoining that
23 person or entity from engaging in that unlawful activity, conduct, or practice pending
24 a hearing on a preliminary injunction, and, in due course, a permanent injunction
25 shall be issued after a hearing, commanding the cessation of that unlawful activity,
26 conduct, or practice complained of, without the necessity of the commission giving
27 bond as ordinarily required in such cases.
28 (2) A temporary restraining order, preliminary injunction, or permanent
29 injunction issued pursuant to this Section shall not be released upon bond.

1 E. The trial of the proceeding for injunction shall be summary and by the
2 judge without a jury.
3 §82.3. Disciplinary actions
4 A. After due notice and hearing in accordance with the Administrative
5 Procedure Act, the commission may refuse to issue a license to any applicant, or may
6 refuse to renew the license of any person, or may restrict, suspend, or revoke any
7 license upon proof that the person has done any of the following:
8 (1) Violated the provisions of this Chapter or the rules of the commission.
9 (2) Attempted to obtain, or obtained, a license by fraud or misrepresentation.
10 B. Any action of the commission taken pursuant to this Section is subject to
11 notice requirements and hearing, adjudication, and appeal proceedings pursuant to
12 the rules adopted by the commission in accordance with the Administrative
13 Procedure Act.
14 C. Refusal to grant a license for failure to pass the licensing examination
15 required by the commission shall not require notice or a hearing.
16 D. If the commission prevails in its disciplinary action, it is entitled to
17 reimbursement of the costs associated with that disciplinary proceeding, including
18 the cost of investigators, stenographers, attorney fees, and other reasonably
19 associated costs which shall be part of the consent order or commission decision
20 issued in that proceeding.

22 §422. Registration of agents

24 D. To produce sufficient revenue to offset the expenses incurred by the
25 division in administering this Chapter, an annual registration fee of one hundred
26 dollars shall be paid. application for registration or renewal of registration of an
27 athlete agent pursuant to this Chapter shall be accompanied by the appropriate
28 registration fee as follows:
29 (1) One thousand dollars for an initial application for registration.

1 (2) Five hundred dollars for a registration based on a certificate of
2 registration issued by another state.
3 (3) One thousand dollars for renewal of a registration.
4 (4) Five hundred dollars for renewal of registration based on a certificate of
5 registration issued by another state.
6 E. The registration or renewal of registration is valid for two years. Renewal
7 of the registration may be made by the filing of an application for renewal.
8 F. All funds received from the payment of the registration fees imposed and
9 collected pursuant to the provisions of this Section shall be deposited into the
10 Department of Justice Legal Support Fund pursuant to R.S. 49:259.
11 Section 2. R.S. 4:422(C) is hereby repealed in its entirety.
