HOUSE BILL NO. 1208

MOTOR VEHICLES: Provides for law enforcement use of fleet camera systems to issue
citations for certain traffic offenses
1 AN ACT
2 To amend and reenact R.S. 32:71(Section heading) and (C) through (E) and to enact R.S.
3 32:71(F), relative to the violation of operating a motor vehicle on the right side of
4 highways; to provide for law enforcement use of fleet camera systems to cite certain
5 violations by mail; to provide for an administrative hearings process; to provide for
6 citation requirements; to provide for allocation of fines; to provide for definitions;
7 and to provide for related matters.
8 Be it enacted by the Legislature of Louisiana:
9 Section 1. R.S. 32:71(Section heading) and (C) through (E) are hereby amended and
10 reenacted and R.S. 32:71(F) is hereby enacted to read as follows:
11 §71. Driving on right side of road; exceptions; citations
12 * * *
13 C.(1) Any law enforcement officer whose vehicle is equipped with a fleet
14 camera system may record any vehicle in violation of this Section, only on multilane
15 highways, for purposes of issuing a citation. The cameras shall record the violation
16 for the purpose of issuing a citation without requiring the law enforcement officer
17 to pull over the vehicle.
18 (2) The video capturing the violation shall include audio and visual
19 recording.

1 (3) Citations issued pursuant to this Subsection may be issued by mail and
2 provide for an administrative hearing process for the driver to appeal the citation
3 violation.
4 (4) Citations issued pursuant to this Subsection shall contain on the back of
5 the citation an attestation wherein the driver who receives the violation can attest
6 either that at the time of the violation, the person who received the notice of violation
7 was not the owner of the vehicle or that the vehicle was in the care, custody, and
8 control of another at the time of the violation. Nothing in this Paragraph shall
9 require that the owner's attestation be notarized. The driver who receives the
10 violation shall have the option to provide information on who was the owner or
11 driver of the vehicle at the time of the violation but shall not be required to do so.
12 (5) All fines collected for violations pursuant to this Subsection shall be paid
13 to the Louisiana office of state police.
14 (6) For purposes of this Subsection, "fleet camera system" means a network
15 of law enforcement vehicle-mounted cameras that capture, store, and analyze video
16 and audio footage while the vehicle is in motion or at rest.
17 C. D. The Department of Public Safety and Corrections, office of motor
18 vehicles, is directed to include a summary of this Section in any instructional
19 publication for drivers.
20 D. E. The Department of Transportation and Development is directed to
21 place signs on multilane highways, in an effort to make motorists aware of the
22 provisions provided for in this Section.
23 E. F. The Louisiana Highway Safety Commission and the Department of
24 Transportation and Development are directed to cooperatively develop and engage
25 a public awareness campaign to notify motorists of the provisions of this Section.

Abstract: Authorizes law enforcement to use fleet camera systems to issue citations for
violations of driving on the right side of highways in Louisiana.
Present law prohibits any vehicle on a multilane hwy. at a speed slower than the posted
maximum speed limit, except when overtaking and passing a vehicle proceeding in the same
direction or when preparing for a left turn at an intersection or into a private road or
driveway. Further provides for fines based on violations of present law as follows:
(1) A fine of $150 for the first offense.
(2) A fine of $250 for a second subsequent offense within a 12-month period of the first
offense.
(3) A fine of $350 for a third subsequent offense within a 12-month period of the first
offense or imprisonment for not more than 30 days, or both.
Proposed law authorizes any law enforcement officer to use fleet camera systems to capture
audio and visual recordings of any vehicle in violation of present law, operating only on
multilane highways, for purposes of issuing a citation. Requires the cameras to record the
violation for the purpose of issuing a citation without requiring the officer to pull over the
vehicle.
Proposed law allows citations issued through proposed law to be issued by mail and provide
for an administrative hearing process for the motorist to appeal the citation violation.
Proposed law requires that citations issued pursuant to proposed law contain an attestation
on the back of the citation allowing the driver who receives the violation to attest either that
at the time of the violation, the person who received the notice of violation was not the
owner of the vehicle or that the vehicle was in the care, custody, and control of another at
the time of the violation. Specifies that the attestation does not need to be notarized. Further
provides the driver who receives the violation with the option to inform on who was the
owner or driver at the time of the violation.
Proposed law requires the fines collected for violations of proposed law be allocated to the
La. office of state police.
Proposed law defines "fleet camera system" as a network of law enforcement vehicle-
mounted cameras that capture, store, and analyze video footage while the vehicle is in
motion or at rest.
