HEALTH: Provides relative to summer meal distribution sites
1 AN ACT
2 To enact R.S. 40:4(A)(7) and 5(A)(22), relative to rural non-congregate summer meal
3 distribution sites; to provide for the distribution of pre-packaged or shelf-stable
4 meals; to provide for the Louisiana Department of Health; and to provide for related
5 matters.
6 Be it enacted by the Legislature of Louisiana:
7 Section 1. R.S. 40:4(A)(7) and 5(A)(22) are hereby enacted to read as follows:
8 §4. Sanitary Code
9 A. The state health officer acting through the office of public health of the
10 Louisiana Department of Health shall prepare, promulgate, and enforce rules and
11 regulations embodied within the state's Sanitary Code covering all matters within his
12 jurisdiction as defined and set forth in R.S. 40:5. The promulgation of this Sanitary
13 Code shall be accomplished in strict accordance with the provisions of the
14 Administrative Procedure Act and, further, in conformity with the following
15 guidelines and directives:

17 (7) The sanitary code shall provide rules and regulations for rural non-
18 congregate summer meal distribution sites that are not considered food service
19 establishments. These sites do not prepare meals onsite and only distribute pre-
20 packaged and shelf-stable meals.

4 Department of Health shall have exclusive jurisdiction, control, and authority:

8 not considered food service establishments.

Abstract: Provides for the distribution guidelines of rural non-congregate summer meal
distribution sites.
Present law provides that the state health officer acting through the office of public health
of the La. Dept. of Health (LDH) shall prepare, promulgate, and enforce rules and
regulations embodied within the state's Sanitary Code.
Proposed law requires LDH to promulgate rules and regulations for rural non-congregate
summer meal distribution sites that do not prepare onsite meals and only distribute pre-
packaged and shelf stable meals.
Proposed law provides that the state health officer and the office of public health of LDH
have exclusive jurisdiction over rural non-congregate summer meal distribution sites that are
not considered food service establishments.
