1 AN ACT
2 To amend and reenact R.S. 33:9074(E), relative to Orleans Parish; to provide relative to the
3 Spring Lake Subdivision Improvement District; to provide relative to the taxes and
4 fees imposed within the district; to provide relative to the term and renewal of such
5 taxes and fees; to increase the maximum fee authorized to be imposed within the
6 district; to provide for effectiveness; and to provide for related matters.
7 Notice of intention to introduce this Act has been published
8 as provided by Article III, Section 13 of the Constitution of
9 Louisiana.
10 Be it enacted by the Legislature of Louisiana:
11 Section 1. R.S. 33:9074(E) is hereby amended and reenacted to read as follows:
12 §9074. Spring Lake Subdivision Improvement District

14 E. Taxing authority. (1)(a) The city council governing authority of the city
15 of New Orleans is hereby authorized to may levy and collect the special taxes or
16 fees, as authorized by the Spring Lake Subdivision Improvement District, as
17 hereinafter specifically provided for a term not to exceed eight years, district. The
18 taxes or fees shall be levied and collected in the same manner and at the same time
19 as all other ad valorem taxes on property subject to taxation by the city are levied and
20 collected,. The governing authority of the city may levy a special ad valorem tax not
21 to exceed five mills or fees not to exceed two hundred dollars three hundred twenty-
22 five dollars per year upon all taxable real property situated within the boundaries of
23 the Spring Lake Subdivision Improvement District. The election on the question of
24 the imposition of the fee may be renewed subject to the provisions of this

1 Subparagraph district. The tax or fee herein authorized in this Subsection shall be
2 levied and collected only after the question of its imposition has been submitted to
3 and approved by a majority of the registered voters of the district voting on the
4 question at a regularly scheduled primary or general election to be conducted in
5 accordance with the provisions of the Louisiana Election Code who vote on the
6 proposition at an election held for that purpose in accordance with the Louisiana
7 Election Code. The amount of the tax or fee may be changed by duly adopted
8 resolution of the board of commissioners, not to exceed the maximum amount
9 authorized in this Subsection. No such tax or fee shall be levied until a plan
10 requiring or requesting the levy of a tax or fee is finally and conclusively adopted in
11 accordance with the procedures prescribed in this Section.
12 (2) The tax or fee shall expire at the time provided in the proposition
13 authorizing the tax or fee, not to exceed eight years, but may be renewed if approved
14 by the voters in the manner provided in Paragraph (1) of this Subsection. If the tax
15 or fee is renewed, the term of the imposition of the tax or fee shall be as provided in
16 the proposition authorizing such renewal, not to exceed eight years.
17 (b)(3) The proceeds of said the tax or fee shall be used solely and exclusively
18 for the purposes and benefit of the district. The proceeds shall be paid over to the
19 Board of Liquidation, City Debt, day by day as the same are collected and received
20 by the appropriate officials of the city of New Orleans and maintained in a separate
21 account. The Spring Lake Subdivision Improvement District district shall provide
22 the Board of Liquidation, City Debt, the approved annual budget against which a
23 quarterly advance disbursement will be provided based on projected expenditures.
24 All such disbursements to the district and subsequent expenditures by the district
25 shall be reconciled quarterly. The proceeds shall be paid out by the Board of
26 Liquidation, City Debt, upon warrants or drafts drawn on the Board of Liquidation,
27 City Debt, by the appropriate officials of the city and the treasurer of the district and
28 shall be used by the district solely for the purposes provided in this Section. The city
29 may retain one percent of the amount collected as a collection fee.

1 (2) Notwithstanding any other provision in this Section to the contrary, no
2 tax or fee authorized in this Section shall be levied until the maximum amount of the
3 tax has been approved by a majority of the registered voters of the district voting on
4 the question at a regularly scheduled primary or general election conducted in
5 accordance with the Louisiana Election Code.

7 Section 2. This Act shall become effective upon signature by the governor or, if not
8 signed by the governor, upon expiration of the time for bills to become law without signature
9 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If
10 vetoed by the governor and subsequently approved by the legislature, this Act shall become
11 effective on the day following such approval.
