INSURANCE: Provides for policy data exemptions of information collected for the
Louisiana Fortified Homes Program Fund
1 AN ACT
2 To enact R.S. 22:439(E)(2)(b), relative to the Louisiana Fortified Homes Program Fund; to
3 provide for the collection of policy data; to prohibit the collection of certain policy
4 data information; to provide for effectiveness; and to provide for related matters.
5 Be it enacted by the Legislature of Louisiana:
6 Section 1. R.S. 22:439(E)(2)(b) is hereby enacted to read as follows:
7 §439. Tax on surplus lines and unauthorized insurance

11 (2) An agreement entered into pursuant to this Subsection may provide for
12 any of the following:

14 (b) The collection of policy data in addition to premium, except that in no
15 case shall the collected data include the name of the insured, the address of the
16 insured, or the coverage limits of the insurance policy.

18 Section 2.(A) The provisions of R.S. 22:439(E)(2)(b) as enacted in Section 1 of this
19 Act shall supersede the provisions of R.S. 22:439(E)(2)(b) of Section 1 of Act No. 79 of the

1 2025 Regular Session of the Legislature when Section 1 of Act No. 79 of the 2025 Regular
2 Session of the Legislature becomes effective.
3 (B) Section 1 of this Act shall become effective on July 1, 2026.

Abstract: Prohibits the collection of certain policy data information.
Proposed law retains proposed law that authorizes the commissioner to enter into
cooperative endeavor agreements or other agreements for the receipt of policy information
on surplus lines, directly placed, and other unauthorized insurance subject to the tax imposed
by present law and proposed law.
Proposed law retains proposed law that permits the commissioner to enter into agreements
that may provide for any of the following:
(1) The use of a clearinghouse to perform functions required pursuant to the agreement.
(2) The collection of policy data in addition to premium.
(3) The computation of the tax due on the portion of premium attributable to each risk
classification.
(4) The assessment of a clearinghouse transaction fee.
(5) The reporting of insurance transactions or policyholders that are exempt from the tax
imposed by present law and proposed law.
(6) Any other provisions that facilitate the administration or collection of the tax
imposed by present law and proposed law.
Proposed law retains the provision of proposed law that permits the collection of policy data
in addition to premium but prohibits the name of the insured, the address of the insured, or
the coverage limits of the insurance policy from being included in the collection of policy
data for the Louisiana Fortified Homes Program Fund.
Proposed law provides that (R.S. 22:439(E)(2)(b) of this Act shall supersede the provision
of Act No. 79 of the 2025 Regular Session.
Effective July 1, 2026.
