LIABILITY/CIVIL: Provides a limitation of liability for owners of property used for
recreational aviation activities
1 AN ACT
2 To enact R.S. 9:2795.8, relative to liability for owners of private airports; to limit liability
3 of airport owners; to provide a definition; and to provide for related matters.
4 Be it enacted by the Legislature of Louisiana:
5 Section 1. R.S. 9:2795.8 is hereby enacted to read as follows:
6 §2795.8. Limitation of liability; private airport; recreational use
7 A. "Airport" has the same meaning as provided in R.S. 2:1(9).
8 B. No owner of a private airport shall be liable for any loss or damage to any
9 person permitted to fly or land aircraft on the owner's property when then loss or
10 damage is related to the recreational use of the property.

Abstract: Limits liability for owners of private airports for permitted recreational use of the
property.
Present law (R.S. 2:1(9)) defines an "airport" as any area of land or water, except a restricted
landing area, designed for the landing and takeoff of aircraft, whether or not facilities are
provided for the sheltering, servicing, or repairing of aircraft or for receiving or discharging
passengers or cargo; all appurtenant areas used or suitable for airport buildings or other
airport facilities; and all appurtenant rights of way including easements through or other
interests in air space over land or water and other protection privileges, the acquisition or

control of which is necessary to insure safe approaches to the landing areas and efficient
operation.
