COURTS/COURT REPORTERS: Provides relative to discretionary transcription of certain
criminal court proceedings
1 AN ACT
2 To amend and reenact Code of Criminal Procedure Article 843, relative to the recording of
3 criminal proceedings; to provide for discretion of the court in the recording of felony
4 and ordinance violation proceedings; and to provide for related matters.
5 Be it enacted by the Legislature of Louisiana:
6 Section 1. Code of Criminal Procedure Article 843 is hereby amended and reenacted
7 to read as follows:
8 Art. 843. Recording of proceedings
9 In felony cases, in cases involving violation of an ordinance enacted pursuant
10 to R.S. 14:143(B), and on motion of the court, the state, or the defendant in other
11 misdemeanor cases tried in a district, parish, or city court, the court, the clerk, or
12 court stenographer shall record all of the proceedings, including the examination of
13 prospective jurors, the testimony of witnesses, statements, rulings, orders, and
14 charges by the court, and objections, questions, statements, and arguments of
15 counsel.

Abstract: Provides relative to discretionary transcription of felony and ordinance violation
proceedings.
Present law provides that motions for required recordation of proceedings for violations of
a felony, certain ordinances, and misdemeanors are to be made by the clerk or court
stenographer.
Proposed law retains present law and adds that the recordation of these proceedings may also
be required by motion of the court.
